West Virginia House committee votes to impeach entire state Supreme Court

A West Virginia House committee on Tuesday reportedly voted to impeach the entire state Supreme Court.

The state's House Judiciary Committee approved 14 articles of impeachment against all four sitting justices of the West Virginia Supreme Court of Appeals, the Charleston Gazette-Mail reported.

The charges against the sitting justices include "unnecessary and lavish" spending of taxpayer dollars, maladministration, corruption and neglect of duty, according to the newspaper.

For the most part, the justices face allegations that they used state resources and money to line their pockets and fund their lifestyles, it added.

Here in PA, our state Supreme Court justice candidates can run as partisans for a 10-year term and we have "retention" elections for additional 10-year term renewals.

the four remaining justices (one already resigned) would be replaced by appointment by Republican governor Jim Justice (no pun intended!). You may remember that he changed his party at a Donald Trump rally in West Virginia last year. The seat of the resigned justice goes on the November ballot.

This impeachment is mostly a farce, aside from the charges against Allen Loughry. Lying to the state house finance committee, followed by lying to the FBI, is a really bad thing anywhere. ("It's not the crime - it's the cover-up" is a Republican mantra!)

As for the other three (all women, one Republican and two Democrats), the charges are minor -- spending too much on office renovation and not having clear policies on use of state vehicles, working lunches, and using office computers at home.

A judicial audit was just completed and found no wrong doing by the three women. None of the three are accused of using state vehicles personally -- only accused of not having a clearly defined policy on the use of state vehicles. Loughry (and the resigned justice Ketchum) used the state cars for personal reasons. None of the three women are accused of misusing their office computers at home -- only accused of not having a clear policy on the use of said computers. Loughry's work computer at home was found to be primarily used for storage of his wife's photographs and for his son's games. As for the working lunches, the audit found that they were actually saving the state money, as the lunches included out-of-town judges. Those judges could get home quicker and saved the state money in cutting their working hours.

As for the renovations, they are attempting to spruce up multiple offices in a building built between 1924 and 1932. It ain't cheap to work on plaster walls and hardwood floors.

For the two male justices, this is a slam dunk - so much so that one of them repaid the state for the personal use of the state car, paid the taxes for that usage, and then resigned from the court. Do I need to mention that he is the Democrat? The Republican justice, Loughry (coincidentally, author of a book called "Don't Buy Another Vote, I Won't Pay for a Landslide: The Sordid And Continuing History of Political Corruption in West Virginia" - I am not making this up!) is fighting it all the way, but he's toast, even with a Republican legislature (see comment above about lying to the FBI!).

The three women justices are getting attacked by the Republican legislature for a couple of reasons -- one - so that Republican darling Loughry doesn't seem quite so corrupt (see, everyone does it!), and two - so that the governor can pack the court with a bunch of Republican cronies. I would expect that Evan Jenkins, congressman from the WV-3 district who lost in a bid for Joe Manchin's US Senate seat. Poor Evan needs a job (despite his being totally unqualified)!

This is a sad day for West Virginia!

The House Judiciary Committee approved 14 impeachment articles, rejecting two others. One of the articles was a catch-all wrapping up almost every controversy the Supreme Court has faced over the past year.

That article accuses all four remaining justices of failing to establish policies about remodeling state offices, travel budgets, computers for home use and framing of personal items.

And the justices each face allegations that they spent thousands too much on the renovations of their own offices: $500,278.23 for Justice Davis, $363,013.43 for Justice Loughry, $130,654.55 for Justice Walker and $111,035.19 for Justice Workman.

Several more articles alleged the justices signed off on a policy to circumvent state law by paying senior status judges as contractors, allowing them to make more than they were allowed.

Some articles focused specifically on actions by Loughry, who separately faces 23 federal charges. The impeachment articles reflect Loughry’s decision to move an antique Cass Gilbert desk to his home, his home use of state computer equipment, his private use of state vehicles, his use of public funds to frame personal mementos and his false statements while under oath to the House Finance Committee.

One rejected article reflected Walker’s use of outside counsel to write an opinion for the court, a $10,000 expense. Another was an allegation that Workman had hiring preferences on the court for workers on her campaign.

If all 4 remaining justices are removed from office, they will be replaced by appointments to be named by Gov. Jim Justice. One justice has already resigned to avoid impeachment. In West Virginia the Supreme Court Justices (5 in all) are elected for 12 year terms.
