Murder trial to begin for Texas officer who killed teen

DALLAS (AP) — A murder trial for a former Texas police officer who killed a black 15-year-old teenager highlights the heightened role video evidence plays in high-profile police shootings that have stirred discourse and triggered protests nationwide over issues of race and law enforcement.

Former Balch Springs officer Roy Oliver, who is white, opened fire last year into a moving car filled with five black teenagers, killing high school freshman Jordan Edwards. Oliver, 38, joined the department in 2011 and was fired after the fatal shooting, an incident that was thrust into a national conversation on the shooting of African Americans by police.

The jury trial is scheduled to begin Thursday in Dallas, but Oliver's defense attorneys on Wednesday filed an emergency stay to delay its start. A spokesperson for the Dallas County district attorney's office said the trial is expected to last about two weeks.

Following the shooting, the Balch Springs police chief reported that police video had contradicted his agency's original statement on the incident. Police first said the vehicle backed up toward officers "in an aggressive manner," but police later reported video showed the vehicle was moving forward as officers, after responding to a report of underage drinking at a house party, approached.

"The more things change, the more they stay the same."

The jury heard four weeks of testimony alleging that six police officers had taken Joe Campos Torres, 23, a laborer, from a cheap cantina, where he was arrested for public drunkeness, to a secluded spot near a bayou, where five of them beat him severely while his arms were handcuffed behind his back.

After a jail booking officer refused to accept Torres because of his injuries and ordered him taken to a hospital, the officers returned to the secluded spot, where one of them allegedly pushed him over a 17-foot embankment into the water after saying, "Let's see if this wetback can swim."

"The environment that created the Torres case continues to exist," Garcia said, "and we can expect a continuation of the same kind of thing."

José Campos Torres was a 23-year-old Mexican-American and Vietnam veteran who was ruthlessly beaten by several white Houston Police Department officers that subsequently lead to his death. He was assaulted by a group of on-duty police officers after being arrested for disorderly conduct at a bar in Houston's Mexican-American East End neighborhood. The officers convicted for the death of Torres, at the state level, received minimal sentencing; 1 year probation and a $1 fine. Torres' murder and sentencing sparked community outrage and lead to multiple community protests, with one gathering escalating to a riot. His death lead to advocacy based non-profits and HPD official's negotiations leading to the addition of policies addressing police-community racial relations.
