States Ask Supreme Court to Limit LGBT Protection

A group of 16 states urged the U.S. Supreme Court Aug. 23 to rule that companies can fire workers based on their sexual orientation and gender identity without violating federal workplace discrimination law.

The states, led by Nebraska Attorney General David Bydalek, asked the justices to overturn an appeals court decision against a Michigan funeral home that fired a transgender worker. They said Congress didn’t intend the ban on sex discrimination in Title VII of the 1964 Civil Rights Act to cover bias against lesbian, gay, bisexual, or transgender employees.

“The States’ purpose is to note that ‘sex’ under the plain terms of Title VII does not mean anything other than biological status,” Bydalek wrote. The friend-of-the-court brief is the latest development in a legal debate that has divided courts and exposed a rift within the Trump administration. The Equal Employment Opportunity Commission says LGBT bias already is banned, but the Justice Department disagrees.

A total of 13 Republican attorneys general, including those representing Texas, Alabama, Kansas, and Utah, signed on to the brief. Three GOP governors— Matthew Bevin (Kentucky), Paul LePage (Maine), and Phil Bryant (Mississippi)—also joined in the court filing.

I accept as a rule of thumb by now that the Republican anti-gay crusader is, himself, secretly gay. No honestly straight person I know gives a shit about that.

The problem is too many STRAIGHT people give themselves a "pass" because they almost always like to claim homophobes are "secretly gay." Frankly, I see it as a form of heterosexist homophobia and it is tiresome. Are most racists secretly another ethnicity or desire to be one? Does that even make sense? Of course not! Are most Islamophobes secretly Muslim or desire to be Muslim? Again, no, of course not. Sadly, too many gay people spew this nonsense too because they know one or two homophobes who turned out to be gay, and of course there are those TWO stupid, MINOR studies that everyone falls over themselves to use as "proof" when it is clear they haven't even read the fucking study.

How about this: when dealing with homophobia deal with the behavior, the hate, and stop assigning sexual orientation, again, almost always a "secret gay" and accept most homophobes are going to be straight and not secretly harboring same-sex feelings. Along with this being homophobic, it is also biphobic because it totally ignores bisexuality as a sexual orientation.

I doubt the Supreme Court is going to take up such a case, referring to "settled law." The reps from the Inquisition States can then go home saying, "we tried to help God out, but them libbruls shot us down, and God is no match for libbruls (or some such)."

I have had wonderful gay and lesbian friends and neighbors for years and a trans
person uses the locker room @ my gym and I have never really had any problems
so why do they have to so shitty?

You can't put that "gay toothpaste" back into the tube they are Americans just like the
rest of us and they deserve the same freedoms as every other American.

in the pipeline will wait for Kavanaugh or whoever else they are able to get on the court. And there are usually more than one for every issue.

Business deregulation etc., as well, and of course those that could affect Trump-Russia. They're pantingly anxious to get Kavanaugh confirmed.
