Democrats Blast Move To Withhold Some Kavanaugh Records

(Bloomberg) -- Senate Democrats criticized the withholding of documents ahead of Tuesdays start of confirmation hearings for President Donald Trumps Supreme Court nominee Brett Kavanaugh, even as a top Republican predicted he would be approved by a healthy margin.
Senate Minority Leader Chuck Schumer of New York said in a tweet that the decision to hold back more than 100,000 pages of documents from Kavanaughs work in President George W. Bushs administration was unprecedented for nominees and has all the makings of a cover up. Dick Durbin of Illinois, the No. 2 Senate Democrat, said only 6 percent of material requested will be released if we are lucky.
If hes so proud of his conservative credentials, show us the record, stand before us, trust the American people and they will trust you, Durbin said on Fox News Sunday.
The Senate Judiciary Committee said Saturday that the release of records is nearly complete. But William Burck, a lawyer representing Bush in the document production, said in a letter released by the committee that after conferring with the White House and the Justice Department, some records would be withheld on the grounds of executive privilege.
Candid Advice According to the letter, the bulk of the documents withheld cover deliberations and candid advice about potential nominees for federal courts, while the remainder include substantive communications between Bush and his staff regarding executive orders and legislation. Trump's White House is asserting executive privilege to protect communications of the Bush White House.
Its not normal, Democratic Senator Amy Klobuchar of Minnesota, who like Durbin is a Judiciary Committee member, said on NBCs Meet the Press about the withholding of documents, adding that some shes seen raise very interesting questions about the nominees views that shes unable to discuss.
The Democrats have more than enough information to understand that this is a highly qualified jurist that should be the next Supreme Court justice, Sen. Ron Johnson (R) of Wisconsin said on ABCs This Week on Sunday. In an earlier time, 30 years ago, he would have passed unanimously.
Kavanaughs nomination has worried some senators concerned about his views on decisions such as Roe v. Wade in 1973, which established a womans right to obtain an abortion. Durbin also raised concerns about Kavanaughs views on presidential accountability, given the convictions of Trump associates stemming from Special Counsel Robert Muellers investigation into Russian interference in the 2016 election and potential collusion by the Trump campaign.

(21,163 posts)Everytime they go on TV bring up why are they rushing this nomination? Why is he not being feted like other Supreme Court nominees? Why is a president under investigation being allowed to rush this guy into the seat? If they have nothing to hide let us properly vet him. This is unprecedented and wrong. It was bad enough they changed the 60 vote threshold for a Supreme Court Justice. What McConnell is doing wrong, and evil.

(41,145 posts)and more in this Huff Post article just posted, wish I'd seen it earlier today. Also notes the records were scanned by a partisan lawyer team which the National Archives staff said they'd ever seen before. That really struck me since I was employed there.

(15,286 posts)Knowing that and if I were a Dem on the judiciary cmte, I'd be bringing in Bush's administrative and communications staff to tell me what went on. I'd bet Nicolle Wallace knows plenty for example. It's not like Kavanaugh was the only party to the decision-making.
There's also tons of Kavanaugh's academic writings, too, that tell where he stands on issues that might come before the supreme court. He can't hide behind executive privilege or dance around what he wrote.

(6,556 posts)Sounds to me like most of them are. We don't have to build a wall at the southern border. The tRump administration is building a wall around transparency in our government. There are so many crappy things being done behind closed doors, you really have to work hard to unearth all of the vile things these people are doing.

(15,286 posts)They can gather without their R colleagues and question Burck. They can get cable TV cameras to televise their hearing, too, I'm sure. Maybe they can't make him testify under oath, but Burck would look like he was hiding something if he didn't answer questions or opted not to show up.

In 1998, Capitol police hunted down Senator Packwood and carried him into the chamber feet first to make a quorum.
That's precedent.

(1,058 posts)as soon as the AZ governor fills the late Sen. McCain's seat, they'll have 51 votes, and a quorum, also, there are a few Dem Senators who are probably going to vote to confirm.
At this point, there is nothing the Senate Dems can do to stop Kavanaugh from being confirmed.
