UPDATE: Judge voids Paul Manafort plea deal, says he 'intentionally' lied to the FBI

Source: CNN

Washington (CNN)Paul Manafort "intentionally" lied to special counsel Robert Mueller's office, breaking the plea agreement that made him the star cooperator in the Russia probe, a federal judge found on Wednesday. Manafort "made multiple false statements to the FBI, the OSC and the grand jury concerning matters that were material to the investigation," including his contacts with his Russian associate during the campaign and later, Judge Amy Berman Jackson wrote on Wednesday.

Jackson's ruling is another stunning turn in Mueller's efforts to uncover Russian interference in the 2016 election, as the first man the special counsel indicted then pursued as a potential cooperator for a year sees the end of any benefits he tried to gain through a guilty plea. Manafort was convicted of various financial crimes in August, and then cut the deal to plead guilty to two charges of conspiracy and witness tampering in September.

In all, Jackson determined Manafort intentionally lied about $125,000 he received for the legal bills, about another unnamed Justice Department criminal investigation and about his interactions with his longtime Russian associate Konstantin Kilimnik while he was campaign chairman and later. Jackson noted twice in her order that two of the topics Paul Manafort lied about, Kilimnik and payments he received for his legal bills were "material to the investigation."

Manafort is still bound by what he agreed to in the plea, so he will not be able to retract his guilty pleas. But the finding frees Mueller's office from its contractual obligations in the plea, like asking for a reduced sentence for him because of his cooperation.

Washington (CNN)Paul Manafort, President Donald Trump's former campaign chairman, lied to special counsel Robert Mueller, a federal judge ruled Wednesday.

Judge Amy Berman Jackson said that Manafort "intentionally made multiple false statements to the FBI, the (office of special counsel) and the grand jury concerning matters that were material to the investigation."

The issue was the subject of a closed-door hearing Wednesday afternoon.

This story is breaking and will be updated.

Federal judge finds Paul Manafort lied to Mueller probe about contacts with Russian aide

By Spencer S. Hsu
February 13 at 6:58 PM

Former Trump campaign chairman Paul Manafort lied to prosecutors with special counsel Robert S. Mueller III about matters close to the heart of their investigation into Russian interference in the 2016 election, a federal judge ruled Wednesday.

The judge's finding that Manafort, 69, breached his cooperation deal with prosecutors by lying after his guilty plea could add years to his prison sentence and came after a set of sealed court hearings.

Manafort had denied intentionally lying after his plea deal, but U.S. District Judge Amy Berman Jackson of the District found he lied in three of five areas alleged by prosecutors. She said she would factor in his deception on other topics at sentencing March 13.

The special counsel's office "has established by a preponderance of the evidence that the defendant intentionally made multiple false statements to the FBI, [Mueller's office] and the grand jury concerning matters that were material to the investigation," Jackson wrote. She specified Manafort's lies included "his interactions and communications with [Konstantin] Kilimnik," a longtime aide who the FBI assessed to have ties to Russian intelligence.

If Russia sent Manafort to the Trump campaign knowing that greedy Trump would glom onto someone who offered to work for free, then they have significant hooks into Manafort. A few threats to use the poison the Kremlin has wielded in England on Manafort’s family would be enough to get his silence. After all, Putin wants to keep Trump in office as long as possible so he can use two more years to help weaken and potentially destroy the USA as a world leader—a role Putin desires for himself. If Manafort tells Mueller the truth, he is most likely the direct link to Teump’s knowledge and approval of conspiracy with a foreign power to steal a federal election.

Now, as to his wife and children finding Novichuk on their doorknobs or Polonium in their soup -- that is going to greatly depend on what Paulie says or doesn't say henceforth.

Remember those old stories about people who make a bargain with Satan? Satan always collects on his debts, he never forgets, and his reach is long. Whether or not you believe in a literal Devil, take it as a metaphor for the behavior of evil humans.

Manafort has spent his life tightrope walking over the Abyss and tapdancing on the edge of the Abyss, and I'm sure the adrenaline high has been magnificent. Now the bill has come due.

JMO -- I have believed from the first that Manafort fears Putin more than US federal prison, and he fears for his family's lives more than he fears for his freedom.

Although there comes a problem with such a pardon: IF he’s pardoned, then that means he HAS TO testify and can’t hide behind 5th Amendment protections. A pardon as I understand it removes the whole protection-from-self-incrimination thing. He’d HAVE TO cough it up in questioning under oath.

There’s another matter too, that COULD be in play here. Just speculation, but I suspect he’s been involved with enough skeevy people over there between Ukraine and The Kremlin that he knows what happens to people who get on Putin’s bad side.

He has damaging info on Trump but is withholding it in the hopes of being pardoned.
If Trump doesn't pardon him he may spill the beans in order to have his sentence reduced therefore Trump has to pardon him if he wants to ensure that Manafort keeps his mouth shut.

Of course once Manafort is out he could still release his info and he wouldn't be able to use the 5th to legally withhold what he knows.
Even if he is implicated in the crimes he couldn't be re-tried for them. There would certainly be attempts to get this out of him.

But Trump also has the Russian mafia as a backup threat to Manafort if he sings.
So pardoning Manafort would probably be the best option for Trump to protect himself.

Wed Feb 13, 2019, 10:33 PM
Feb 2019

from the NYT -

<...>

The prosecutors also told the judge that Mr. Manafort deceived them about transferring Trump campaign polling data to Mr. Kilimnik during the campaign. The New York Times has reported that the data included both private and public data, and that Mr. Manafort wanted the information delivered to two Ukrainian oligarchs who had financed Ukrainian political parties that were aligned with Russia.

Mr. Manafort’s lawyers had said that Mr. Manafort had only wanted to share public data in the interest of promoting himself in hope of winning more work through Mr. Kilimnik or the oligarchs. Those oligarchs and their allies had paid Mr. Manafort tens of millions of dollars in Ukraine to help Viktor F. Yanukovych win the presidency. Mr. Yanukovych was forced out of power in a popular uprising in 2014 and fled to Russia. But the prosecutors pitted Mr. Manafort’s assertions against those of Rick Gates, Mr. Trump’s former deputy campaign chairman. Mr. Gates pleaded guilty to two felonies and has been cooperating with Mr. Mueller’s team for the past year.

During the earlier hearing, Mr. Weissmann appeared to suggest that Mr. Manafort’s lies about the polling data were too important to dismiss as innocent lapses of memory. Whether any Americans, wittingly or unwittingly, engaged with Russian who were trying to interfere in the presidential election went to “the core” of the special counsel’s inquiry, Mr. Weissmann said. He suggested that Mr. Manafort might have been trying to cover up the data transfer because it might hurt his chances of winning a presidential pardon for his crimes.

If it became known that Mr. Manafort had given Mr. Kilimnik the campaign’s polling data, Mr. Weissmann said, it could have “negative consequences in terms of the other motive that Mr. Manafort could have, which is to at least augment his chances for a pardon.”

Look at the financial crash of 2008. A few of the lesser names get jail time, while most of the higher ups may get a slap on the wrist if anything.

Manafort, Flynn, Cohen, Stone, etc are the cronies who will take the fall in all of this, ultimately protecting higher ups like Trump, Trump Jr, Pence from getting the gavel.

Manafort knows he stands a better chance of survival in prison than out in public where the Russians and Trump's mafia goons can get to him.

79. So now what?

Doesn't matter who he's protecting. Probably Trump. Probably his Russian handlers. But as long as he lies, he holds out hope for a Trump pardon. And he could still be pardoned, right? And even if he's sentenced to 10 consecutive life terms, he'd be free as a bird, free to move to Ukraine, or Russia.

We are definitely in uncharted territory.

Add this to today's reporting that trump is going to declare a national emergency anyway. That trump begged hannity to frame the wall loss as a wall win. That fox refuses to air an ad about a short award-winning documentary about Naziism in America.

We're no longer at the point of waking up to the question, what fresh new hell awaits us today. We now have to ask that question upon waking up, after lunch, at dinner, and at bedtime.

80. It's possible that not all charges that were applicable

were brought up in the federal case (we know that some that were did not prevail). Those ancillary charges could be brought up later or even by the state of VA assuming they violated state law - notably involving taxes and tax evasion (where any state charges would be out of reach for a pardon).
