Trump says administration looking 'seriously' at ending birthright citizenship
Source: The Hill
President Trump on Wednesday said his administration is once again seriously considering an executive order to end birthright citizenship months after several lawmakers cast doubt on his ability to take such action.
"We're looking at that very seriously," Trump told reporters as he left the White House for Kentucky. "Birthright citizenship, where you have a baby on our land -- walk over the border, have a baby, congratulations, the baby's now a U.S. citizen."
"We are looking at birthright citizenship very seriously," he added. "Its, frankly, ridiculous."
The president proposed ending the practice that grants citizenship to those born in the United States during his 2016 presidential campaign. He revived the idea last year, saying he would sign an executive order to enact the change. Numerous lawmakers, including several Republicans, quickly pushed back on the idea and argued Trump lacked the authority to make such a change using an executive order. They cited that birthright citizenship is a right enshrined under the 14th Amendment.

(2,227 posts)Imagine about 20 to 25 years from now...
All those Russian/American dual citizens can fly in, set up, and do whatever they want, and we have given them absolute free access. Thanks to turdface allowing his properties to be used for that purpose.
Don't you think that Putin sees this as an easy way to get us? He is always looking at the long term plan....
Apparently there are hotels set up on both coasts, just for rich foreigners to fly in, have the baby and leave, and it is an American citizen. (I don't know if the west coast hotels are the turds... but Miami has them.)
So, on one hand we have POC babies and children, being held indefinitely, and while that is happening they are receiving NO education, so they are angry AND uninformed (and if they grow up in the US, angry and uninformed, they will also have easy access to guns of any kind)
and
on the other hand we have a perfect birthing and incubation of Russian infiltrators, with money to do whatever they want, hell bent on causing maximum chaos...
What could possibly go wrong?
I have no problem with making it a little more difficult to being an American citizen.
That DOESN'T mean I am in agreement with turdface. There can be a rational and workable solution.

Basically, what we have is a man flailing around trying to find something to save his dying presidency. We have had enough (Dayenu!) of him and his enablers.

Clearly, a child born to a foreign diplomat stationed in the US is not a US citizen. It could also be argued that if an invading army conquered part of the US, that children arising from such a circumstance also would not be covered by the Amendment.
The Trump administration will use that line of reasoning with the SCOTUS.

(3,164 posts)about ensuring that slaves and their children would be citizens. I do think that was the original intent, but the wording of the Constitution is what it is regardless of any original reasons; anyone who doesn't like what the Constitutions says needs to get it changed rather than bitch or try to override it, left or right.

(20,018 posts)The 1936 Soviet Constitution, adopted on 5 December 1936 and also known as the Stalin Constitution, redesigned the government of the Soviet Union. It nominally granted all manner of rights and freedoms, and spelled out a number of democratic procedures. In practice, by asserting the "leading role" of the Communist Party, it cemented the complete control of the party and its leader, Joseph Stalin.

While the effort to write, pass, and ratify the 21st was ongoing, FDR issued an order which changed the 0.5% to 3.2%, so Americans could have beer again.

(35,347 posts)At least some by EO.
It's been done a few times, with different laws and provisions. Saying that it's only the formal militia, or that arms aren't the heirs to 18th-century firearms but precisely 18th-century firearms, or that "bear" only includes inside your house and to a local firing range (but nothing more) aren't that dissimilar.
Upthread there's a Soviet example. On the other hand, the Soviet constitution gave the rights to gun ownership. Except in practice you needed registration, training, permission, the gun had to be kept in a gun locker under militia or gun-range supervision, and if you wanted to transport it for, say, hunting you needed a special permit. (The right to own firearms was as carefully expanded and broadened as the right to freely practice religion.)

Melania someday needs to be stripped of her citizenship IF she committed fraud to get it and summarily deported back to Slovenia, back to the minor leagues of gold-digging and grifting. Same for her chain-migration grifting parents.

This would become a solid, parallel and and unambiguous precedent for nullifying the 2nd amendment and getting real gun reform accomplished. So, the next time a Dem occupies the White House (and there WILL be a next time at some point) we can win on that issue using the Republicans' own rules.

(4,473 posts)United States v. Wong Kim Ark, 169 U.S. 649 (1898). Wong was born in San Francisco, the son of a Chinese couple who, because of the Chinese Exclusion Acts, were legally prohibited from becoming US citizens. Wong had gone to China to visit relatives, and on return to the US, was refused admittance under the Chinese Exclusion Acts. He sued, saying that under the Fourteenth Amendment, his birth in the US made him a citizen.
The Supreme Court, by a vote of 6-2, agreed with Wong. Justice Gray wrote the majority opinion, which basically says that everyone, with a few specific exceptions -- chiefly the children of diplomats -- born in the US is a US citizen. He has a very interesting discussion of the term "natural born citizen". See https://www.law.cornell.edu/supremecourt/text/169/649
