Police can start enforcing Ariz. immigration law, judge rules

A judge has ruled that police in Arizona can immediately start enforcing the most contentious section of the state's immigration law, marking the first time officers can carry out a requirement that officers, while enforcing other laws, question the immigration status of those suspected of being in the country illegally.
The decision on Tuesday by U.S. District Judge Susan Bolton is the latest milestone in a two-year legal battle over the requirement. It culminated in a U.S. Supreme Court decision in June that upheld the provision on the grounds that it doesn't conflict with federal law.
Opponents who call the requirement the "show me your papers" provision responded to the Supreme Court decision by asking Bolton to block the requirement on different grounds, arguing that it would lead to systematic racial profiling and unreasonably long detentions of Latinos if it's enforced.
Other less controversial parts of the law have been in effect since July 2010, such as minor changes to the state's 2005 immigrant smuggling law and a ban on state and local government agencies from restricting the enforcement of federal immigration law. But those provisions have gotten little, if any, use since they were put into effect.

(53,661 posts)Okay, I got nothing. This is gonna suck. I wonder if I was driving there if they'd ask me for my papers. If they didn't, that would be unfair.

(67 posts)But since your DL, proof of insurance and registration are considered your "papers" you'd be just fine.

there are still states that don't require birth certificates or proof of citizenship to get a DL.
the Arizona law doesn't count these states' DLs as adequate.
in other words, to avoid being detained, an American citizen needs to carry a Passport and/or Birth Certificate because of the stupidest law in the USA, which Arizona has now.

(67 posts)My AZ DL was issued without a BC based on my MN DL which was also issued without a BC, and they didn't even invalidate the MN one.
And that was only 5 years ago.

and in case you didn't know, there are 49 other states, whose citizens, like myself, would not have an "Arizona Driver's license". Without an Arizona driver's license, my proof (otherwise I'm assumed "guilty", having to prove my innocence then) couldn't be my driver's license if I'm from a state that doesn't require proof before granting one.

(3,118 posts)- they since amended it so that they confirm the immigration status of all persons taken into custody but they retained the ability to inquire as to immigration status without arrest should they have reason to do so. There were other aspects to the ordinance having to do with county services that would not be available to illegal immigrants.
Initially there was concern that people would be profiled, which is why they amended it so that they confirm status of all arrested persons.
