BETSY DEVOS COULD FACE JAIL AFTER JUDGE RULES SHE VIOLATED 2018 ORDER ON STUDENT LOANS

Education Secretary Betsy DeVos has been threatened with the possibility of jail after a judge deemed she was violating a court order for continuing to collect student debts on a now-defunct school.
That ruling, handed down in June of 2018, was made by U.S. Magistrate Judge Sallie Kim and prevented DeVos and her Department of Education for going after former students at the bankrupt Corinthian Colleges Inc.
However, Kim said she was "astounded" to discover that DeVos was violating the court order at a hearing in San Francisco on Monday after a filing by the Education Department earlier disclosed that more than 16,000 former students at Corinthian College "were incorrectly informed at one time or another ... that they had payments due on their federal student loans."

"I'm not sure if this is contempt or sanctions," she added. "I'm not sending anyone to jail yet but it's good to know I have that ability."

Todays hearing was a case management conference where the judge addressed a September 18 filing by Secretary DeVos that revealed she had continued to collect on the debt of thousands of former for-profit college students a direct violation of the courts injunction ordering the Department not to collect on those debts. According to the Departments filing:
The Department demanded incorrect loan payment from 16,034 students
Of those students, 3,289 student borrowers made one or more loan payments because of these demands, which they were not actually supposed to pay
The Department has still not confirmed that 1,147 students loans are in the correct status, leaving those students in limbo
The Department has harmed the credit of 847 non-defaulted students
The Department subjected 1,808 students to involuntary debt collections (garnished their wages or taken their tax refunds or benefits)

The law should be "lawing" for a change. No privileges! None! If we keep bending the rules, then that is not about particulars, the whole system is in jeopardy. Devoss is just one example. She really could use some time in the can. It would be a "lesson", pun intended.
Let's have some solid examples made. Otherwise, it is time to get more adamant and concerned about a two-tiered legal system. Oh, I know, the privileged have a really big advantage and get off easier when caught, but this is not a systemic THREAT! Who is going to stand for making a joke of our laws and Constitution? I am not keen on America being a banana republic with it's citizens plunging into an increasingly 3rd-World status.

They're two different messages in two very different eras, which is why I juxtaposed the two women together. The object lesson is the sender of the message to the public. Back then it was that women can't do the illegal thing her male counterpart does without getting caught. With Betsy it's the same message with the wealthy male counterpart, which is why I said "like Martha Stewart", whom I actually really like, Shruggie.

(1,336 posts)I had an interesting conversation with my new nephew who is German but taking up residency in Canada. We talked about Trump and all his nefarious dealings, especially with Deutschebank. Nephew says that it is well-known in Germany that the bank is as crooked as they come but always seems to manage to escape legal proceedings. Not surprising at all that the bank would be the only one to lend money to Trump.
Europeans as a whole (well, except for the far right-wing populists) absolutely despise Trump and the only reason any of their leaders visit or otherwise pay attention is for trading purposes.
It was so interesting to get the perspective of someone from across the pond.....

(11,001 posts)agencies under the umbrella of the Department of Education refuse to talk to students and then seek garnishment ignoring those who legitimately try to pay the loans. My daughter overpaid and almost had to get a lawyer to get her money back. It is a shakedown operation. Just google Department of Education illegal collections and see the many complaints.

So much of the public is harmed, and not a damned thing gets done to deter further harm.
Legal declarations of guilt not followed by enforcement is corrupt justice.
This ruling and a bus token will get the victims across town.

However, Martha Stewart spent some time in jail and she was wealthy, so there's always that slight chance. Except I believe Martha was a Democrat so there's that.
