Texas judge: Hospital can remove baby from life support

DALLAS (AP) A Texas judge on Thursday sided with a hospital that plans to remove an 11-month-old girl from life support after her mother disagreed with the decision by doctors who say the infant is in pain and that her condition will never improve.
Trinity Lewis had asked Judge Sandee Bryan Marion to issue an injunction in Tarrant County district court to ensure that Cook Childrens Medical Center doesnt end her daughter Tinslee Lewis life-sustaining treatment. Texas Right to Life, an anti-abortion group that opposes the 10-day rule and has been advocating for Tinslee, said the girls mother will appeal the judges decision.
Doctors at the Fort Worth hospital had planned to remove Tinslee from life support Nov. 10 after invoking Texas 10-day rule, which can be employed when a family disagrees with doctors who say life-sustaining treatment should be stopped. The law stipulates that if the hospitals ethics committee agrees with doctors, treatment can be withdrawn after 10 days if a new provider cant be found to take the patient.
In a statement issued by Texas Right to Life, Lewis said she was heartbroken over the judges decision. I feel frustrated because anyone in that courtroom would want more time just like I do if Tinslee were their baby, she said.

The hospital said she has a rare heart defect and suffers from chronic lung disease and severe chronic high blood pressure. She hasnt come off a ventilator since going into respiratory arrest in early July and requires full respiratory and cardiac support, deep sedation and to be medically paralyzed. The hospital said doctors believe shes suffering."

(742 posts)being in this decision chain. Heartbreaking for all involved. Reminiscent of Terri Schiavo. In that case, I felt the husband had the right to decide (not the parents). In this case, the parents need to make the decision. It's sad that Texas law, a judge and doctors will make the decision for them. Sucks all around.

(5,073 posts)It's a law from Gov G W Bush days, and the state has removed people from life support whose family wanted more time for their loved one. The cases I remember are another case of a hopelessly damaged baby, an elderly man in a coma, and a young woman dying of cancer (in a religious hospital--Baylor) who wanted to die in her mother's arms, but the hospital wouldn't wait for her mother to arrive from Africa.

(6,929 posts)But I do have experience with futile care in adults. It is awful and hard on everyone.
But there are situations where continuing care is indeed futile. The patient has no input and the medical professionals and family are left with terrible decisions. I have participated in getting a family to understand that we are not going to heal and not going to get well and leave room. I watched so many doctors and nurses avoid direct questions or give vague answers. I made people cry at times, but I never lied to them. That is an extra level of cruelty on top of what they are having to accept.
People do die from what is wrong with them. A life in ICU is not good for the patient. It is usually painful and messy and none of those treatments are without side effects.
Keeping the facts from someone is cruelty. Helping them to see the truth is the job.
And yes, I understand that some will never accept it even when the medical professionals do their job well.

(9,170 posts)Another article I read says that she goes into cardiac arrest often and must be resuscitated (presumably with a defibrillator) 2 to 3 times a day...all while being completely paralyzed.
I wouldn't wish that on my worst enemy.
