Graham suggests changing Senate rules to begin impeachment trial without articles

Washington — Top Republican Senator Lindsey Graham of South Carolina, one of President Trump's key allies in Congress, proposed the GOP-controlled Senate change its rules to allow the president's impeachment trial to begin if House Speaker Nancy Pelosi does not send the articles of impeachment to the upper chamber this week.

Calling Pelosi's decision to withhold the two articles, passed by the House in a historic vote in December, a "political stunt," Graham told Fox News on Sunday that House Democrats are "trying to hold these articles over the head of the president."

"If we don't get the articles this week, then we need to take matters in our own hands and change the rules, deem them to be delivered to the Senate so we can start the trial, invite the House over to participate if they would like, if they don't come, dismiss the case and get on with governing the country," Graham said.

"We're not going to let Nancy Pelosi use the rules of the Senate to her advantage. This is dangerous for the presidency as an institution," Graham said. "They've impeached the president, but the speaker of the House is holding the articles back, trying to extort from the majority leader of the Senate a trial to her liking."

Unless you actually have evidence of abuse of underage people in which case you should call law enforcement right away.

Whensoever the Senate shall receive notice from the House of Representatives that managers are appointed on their part to conduct an impeachment against any person and are directed to carry articles of impeachment to the Senate, the Secretary of the Senate shall immediately inform the House of Representatives that the Senate is ready to receive the managers for the purpose of exhibiting such articles of impeachment, agreeably to such notice.

All it says is that the house is solely responsible for impeachment, and the senate is solely responsible for trial. It is silent over how the two houses work together.

It doesn't even say the house has any involvement once it impeaches the potus.

The senate rules say it has to wait for the house to deliver the managers. They are solely responsible for those rules.

They "can" change the rules and hold any kind of votes they want. And yes, they will get three votes plus pence. In fact, they will probably get 54 straight votes. Romney won't go against putin.

Well! I do declare! The delicate Southern Gentleman from South Carolina is having what can only be described as a hissy fit. If you listen very carefully, you can hear the unmistakable sounds of Little Lindsey stomp-stomp-stomping his way down the terrazzo floors in the Halls of Congress. Click-click-click go the heels and toes of his high-gloss patent leather tap shoes. The shine is so bright you might overlook his color-coordinated ankle-high socks embroidered with his initials in the cuff. Eventually he reaches his office and slams the door behind him with a level of force and strength that defies the meek appearance he has when wearing his short pants and matching waistcoat. Still, even with the door firmly closed, passers-by can hear the shrill shrieks emanating from behind the polished oak door... along with the unmistakable sounds of his glass menagerie collection being thrown to the floor. Why! Lordy, you never heard such a fuss! Someone needs to check on him.

Trump to be under impeachment during the state of the union. As one republican said, trump would be a lunatic in a rage fit. It wouldn't matter what was on his telie-promptie. He would take a glance behind him, see nancy, and go off road from the first breath.

They know this. They have predicted it.

They would rather let him take his victory march.

And that's why they will change the rulez and hold a "trial" without any house involvement. They will probably even call the bidens, obama, and hillary to testify. The dems won't even get to ask questions or make statements. And of course, no dem witnesses or documents.

But it seems to a minority opinion; the prevailing sentiment is that the vote in the House established the impeachment.

If that's the case then the Senate has the power to try it, and if they change the rules then they don't have to wait for the House to deliver the articles.

which spells out how an impeachment and referral to the Senate for trial takes place. It's not a matter of Senate rules in any way. Those rules might cover the actual trial, but not the process that leads up to it. That's a Constitutional matter.

It grants to the House the power to impeach and to the Senate the power to try the impeachment.

If Trump is already impeached (which seems to be the conventional wisdom), then the Senate could try him if it changes its own rules. There's nothing in the Constitution to prevent it.

Cons have been playing against the rules since Nixon and Watergate. Regan went to Grenada without authorization to show his war powers against a tourist destination. Grenada wanted a 9000 ft runway like the surrounding islands. But Reagan had a choice. Recall the fleet headed for Lebanon to avenge the death of 234 Marines or go to Grenada and get an easy approval as a war monger. If protecting the students was a priority why didn't the secure all the dorms?
Bush had troops go to Panama on the leanest of reasonings to rescue his informant, confidant, moneylaundering, hitman so he could not testify. Twenty five Americans lost their lives.
Jr went after the wrong guys and it continues today. Saudi Arabia had 14 or 19 terrorists on 9/11. While Bush and Cheney fiddled the Pentigon burned. As well as the Twin Towers. So we go attack Iraq and Afghanistan and begin 18 years of nationbuilding that Jr accused Clinton of doing.
Now even more corruption on an unparalelled scale.
