Proposed Book Banning Bill in Missouri Could Imprison Librarians

(New York, NY) – A bill proposed in Missouri this month represents a transparent, shameful attempt to legalize book banning in public libraries within the state, PEN America said today.

The bill — the Parental Oversight of Public Libraries Act or House Bill 2044 — aims to add several provisions to the state’s funding law for public libraries. These new provisions establish “parental library review boards” that would evaluate whether any library materials constitute “age-inappropriate sexual material.” Members of these five-member boards, who would be elected at a town meeting by a simple majority of voters, are empowered to determine whether material is appropriate, including by evaluating its literary merit. Public librarians are explicitly barred by the statute from serving on such review boards, even if they are from the community.

“This is a shockingly transparent attempt to legalize book banning in the state of Missouri,” said James Tager, deputy director of Free Expression Research and Policy at PEN America. “This act is clearly aimed at empowering small groups of parents to appoint themselves as censors over their state’s public libraries. Books wrestling with sexual themes, books uplifting LGBTQIA+ characters, books addressing issues such as sexual assault—all of these books are potentially on the chopping block if this bill is passed.”

Under the act, the boards would hold public hearings to receive suggestions as to possible inappropriate books, and would have the authority to order the library to remove any such material from access by minors. Any public library who allows minors access to such “age-inappropriate materials” would have their funding stripped, and librarians who refuse to comply with the act can be fined and imprisoned for up to one year. /snip

As long as funding is discretionary, a Library can maintain its freedom of selection by refusing State funds. As an example, the Federal minimum drinking age isn't a mandate; it's a requirement for eligibility for highway funds.

they want out of the hands of people are covered in the Bible as well. What shall they do?

We fought similar things in town over here in crazy ole Kansas, thankfully not as crazy as Missouri is right now. We shut them down every time but then it was easier as a city wide issue than a state with the legislature behind it.

My kids moved over the state line and for years told me we were nuts to stay in Kansas. I don't mention it to them but I do smile once in a while when they mention some things going on over there.

It might be construed that they are going to have the offending material removed from public access and that said removal would be done "by minors at the public library."

That sounds like minors get to check out the books after all.

Here's a radical solution for Missouri: Require that all books taken out by minors be checked out of a library by their parents, unless parents sign a waver.

That solution sucks because it would retard young people's use of libraries but it might satisfy evangelicals.....

Meanwhile due to peer pressure, I'll bet most of those parents buy their children smart phones that can access virtually anything their self-righteous do-gooder minds are trying to prohibit from free access in public libraries. (I need a hypocrisy emoji here)

they buy them the phones, and then have no idea how to regulate them, so they don't. They rely on their precious gifts from GGAAWWDD to be honest and true to what their parents and Jayesus tells them. (Been around too many offspring of pastors. They usually are little hellions and get away with most of their crap due to this lineage.) So, they get to go buck wild on their phones without their parents knowing a thing, and when they get caught, they usually just complain about the phone company allowing their child access to blah blah blah.
I have a more radical solution for Missouri and all of the US. Since our modern society promotes the idea that kids (parents as well it seems) should be afraid of anyone who is not the parents, let the parents do the work. A public library is for the public, not just those few people who want it to be their library.
