Fort Bragg Brig. Gen. Jeffrey Sinclair facing sodomy, other charges

A Fort Bragg brigadier general has been charged with forcible sodomy and other offenses involving sex, pornography and alcohol, Army officials said this morning.

The Fayetteville Observer has been monitoring the case and learned of the charges this morning.

"Brig. Gen. Jeffrey A. Sinclair has been charged with multiple violations of the Uniform Code of Military Justice," said Col. Kevin V. Arata, the 18th Airborne Corps public affairs officer.

According to Fort Bragg, the charges include forcible sodomy; wrongful sexual conduct; attempted violation of an order; violations of regulations by wrongfully engaging in inappropriate relationships and misusing a government travel charge card; violating general orders by possessing alcohol and pornography while deployed; maltreatment of subordinates; filing fraudulent claims; engaging in conduct unbecoming an officer and a gentleman; and engaging in conduct prejudicial to good order and discipline, or of a nature to bring discredit upon the armed forces.

Sinclair was sent back to Fort Bragg from Afghanistan several months ago while serving as deputy commander of the 82nd Airborne Division headquarters.

FORT BRAGG, N.C. — An Army brigadier general who served five combat tours in Iraq and Afghanistan has been charged with forcible sodomy, multiple counts of adultery and having inappropriate relationships with several female subordinates, two U.S. defense officials said Wednesday.

The defense officials spoke to The Associated Press on condition of anonymity because they were not authorized to provide details on the case.

Brig. Gen. Jeffrey A. Sinclair faces possible courts-martial on charges that include forced sex, wrongful sexual conduct, violating an order, possessing pornography and alcohol while deployed, and misusing a government travel charge card and filing fraudulent claims.

Sinclair, who served as deputy commander in charge of logistics and support for the 82nd Airborne Division in Afghanistan, was sent home in May because of the allegations, the officials said.


Sinclair was informed of the charges on Monday but has not been placed under arrest. The next step will be an Article 32 investigation, including a preliminary hearing to determine if the matter should go to trial. No date has been set for the hearing, which Arata said would be open to the public.

Sinclair had arrived in Afghanistan for his deployment in September 2011, but had been serving as the division's deputy commander since July 2010.

but I couldn't help but think about, that they cannot possess porn? I'm just thinking that you have a HUGE
group of testosterone laden males, stuck in an environment such as Afghanistan, away from wives, girl friends (or partners, boyfriends)....and porn is a violation? Just say'n!

And also, not that it matters, but those "attacked"...female or male? Just ask'n this time.

Is it because the Army has labeled it 'forced sex'? Either way, every time I saw it I was sickened. Watch for NBC's show on the high number of rapes of soldiers deployed to the middle east.

EVEN MORE DISGUSTING when it happens this high in the chain of command!

rape and carnal knowledge:

"Rape is sexual intercourse by a person, executed by force and without consent of the victim. It may be committed on a victim of any age. Any penetration, however slight, is sufficient to complete the offense."

"Carnal knowledge is sexual intercourse under circumstances not amounting to rape, with a person who is not the accused’s spouse and who has not attained the age of 16 years. Any penetration, however slight, is sufficient to complete the offense."

Maximum punishments.

(1) Rape. Death or such other punishment as a court-martial may direct.

(2) Carnal knowledge with a child who, at the time of the offense, has attained the age of 12 years. Dishonorable discharge, forfeiture of all pay and allowances, and confinement for 20 years.

(3) Carnal knowledge with a child under the age of 12 years at the time of the offense. Dishonorable discharge, forfeiture of all pay and allowances, and confinement for life without eligibility for parole.
