Kansas' high court weighs virus limits on religious services

BELLE PLAINE, Kan. (AP) — An attorney for Kansas Gov. Laura Kelly told the state Supreme Court on Saturday that a Republican-dominated legislative panel exceeded its authority when it overturned the Democratic governor’s executive order banning religious and funeral services of more than 10 attendees during the coronavirus pandemic.

Lawmakers countered that the language in a resolution they contend gave the panel that authority was a compromise reached at the time with Kelly and was intended as a check on her power at a time when the full Legislature couldn’t meet because of virus concerns.

The hearing, which was the court’s first conducted completely via video conferencing, came one day before Easter, which is typically the busiest day on the Christian calendar in terms of church attendance.

The justices said they would confer right after the arguments were presented and would try to reach a decision quickly.

They are smart to meet via Zoom. They were nearly all appointed by current Democratic Governor, Laura Kelly, or by Kathleen Sebelius.
It is a committee of the legislature that is challenging the gov's right to govern--they are the villains.

but if they aren't willing to meet in person, then they sure as fuck shouldn't be willing to okay hundreds, maybe thousands of people gathering in close quarters.

if they approve the GOP attempt to overturn Governor Kelly's orders--which were originally agreed upon by the legislative committee, btw. Something happened Wednesday that made them decide to use Easter to polarize the whole thing, when they'd been playing nicely with others for about two weeks.

But what I really don't get is this interest in calling them hypocrites in advance. A hypothetical insult of decent, smart people. If they do X, they will be hypocrites. Yes, but no indications that they will do X, so why does this have so much energy?

Keeping the faith. Smart people Zoom. Smart people know the laws. Standing by.

However, after the service is over, all of the participants need to be forcefully quarantined for two weeks.

I think participants should be quarantined until after the pandemic has taken its leave. The people who crowd churches cannot be expected to be responsible after church services are completed on Easter Sunday. They must all be treated as Typhoid Marys until the pestilence has departed, or else they'll be getting together in close quarters to pray and barbecue, to shop maskless and gloveless, and in general to challenge the virus in the name of the Lord and, doing so, putting innocent folk at risk. So, yeah, make the bastards stay home.

As to the pastors and preachers who summoned the faithful: they should all be required to wait the pandemic at home, just like their congregants/parishioners, but should also be required, afterwards, to spend a couple of years working among the homeless and poverty-stricken, and living amongst them instead of in their actual homes (which, in some cases, are quite palatial) -- in the name of Christ Jesus, Amen.

TOPEKA — Kansas Supreme Court justices for the first time in the court’s history appeared by video conference Saturday morning to referee a battle royal between Democratic Gov. Laura Kelly and Republicans who oppose her ban on large church gatherings.

Justices planned to make a swift decision on who has ultimate authority to manage an unprecedented health crisis — the governor, or a GOP-led panel of legislators.


The Legislature in March passed a resolution giving the governor extended emergency powers for dealing with COVID-19. The resolution, which passed by near-unanimous vote, also gives the Legislative Coordinating Council the ability to overturn an executive order.

The LCC, a panel of five Republicans and two Democrats, on Wednesday reversed the governor’s decision to limit church gatherings to no more than 10 individuals. A day later, the governor petitioned the Supreme Court to intervene.

The number of confirmed cases of COVID-19 in the state grew Saturday by 102, to 1,268. Kansas also reported five more deaths, bringing the total to 55.

The state has identified four outbreaks stemming from religious gatherings.


btw - Rachel reported on the church gathering outbreaks in Kansas a couple of days ago.
