Harvard, MIT Sue Trump Administration Over International-Student Policy
Policy forbids international students from staying in U.S. if classes are taught entirely online

Harvard and the Massachusetts Institute of Technology sued the Trump administration on Wednesday over its new policy barring international students from coming to or remaining in the U.S. if their classes are taught entirely online.
The suit, filed in the U.S. District Court in Boston, alleges that the new policy issued by Immigration and Customs Enforcement, which overturned guidance universities had been given in the spring, came with no notice and was "arbitrary and capricious."

(12,265 posts)Most universities around the country, especially state funded ones, have already had to raid their foundations to help keep them afloat during this period of hating education. State legislatures have been cutting higher ed for over 20 years, since Reagan so they don't have the money to fight this. I'm glad MIT and Harvard are doing it for the sake of everyone.

As a university with a profound commitment to residential education, we hope and intend to resume full in-person instruction as soon as it is safe and responsible to do so, Bacow wrote. But, until that time comes, we will not stand by to see our international students dreams extinguished by a deeply misguided order. We owe it to them to stand up and to fightand we will.

(2,032 posts)The USA is a Covid cesspool right now, and a lot of people expect a second larger wave. It is good to shutdown non-essential travel, especially international travel. As long as they can still take the coarse for credit online.

(26,748 posts)Isn't it already the case that online-only students do not qualify for a student visa to be in the country?
If so... I think it's much harder to argue that the failure to change an existing policy is "arbitrary". I guess the question will be to what extent "guidance" can be considered as binding the policy-making body.
