U.N. complaint alleges illegal pressure on Spain to stop Bush torture trials

A complaint filed Thursday with the United Nations Special Rapporteur on the independence of judges and lawyers alleges that the United States and the government of Spain colluded to stop the Spanish judiciary from prosecuting U.S. figures for torture under a legal theory construct known as universal jurisdiction.
Those individuals that Spanish courts sought to prosecute included six former Bush administration attorneys who approved the use of torture tactics in enemy interrogations. The U.S.-based Center for Constitutional Rights (CCR) filed the complaint with the help of the Berlin-based European Center for Constitutional and Human Rights (ECCHR).
The allegations of improper influence on Spains judiciary spring from a collection of 14 U.S. embassy cables (PDF) http://ccrjustice.org/files/Appendix%20whole.pdf authored by the Bush and Obama administrations, revealed by anti-secrecy website WikiLeaks.
We submit that the U.S. diplomatic cables the key documents of which are annexed to this complaint demonstrate a coordinated effort, led by U.S. officials and involving certain senior members of the Spanish government, to obstruct and otherwise interfere with the outcome of these three cases, the complaint reads. We maintain that the aim of this concerted action was to prejudice the outcome of these cases in favor of the defendants and thereby subvert the course of justice in Spain.

The judge requested access to "all documents relating to the justification and modalities of (US) armed operations in Afghanistan and Pakistan and to the treatment of persons arrested during these operations," the documents said.
The three Frenchmen who made the accusations -- Mourad Benchellali, Nizar Sassi and Khaled Ben Mustapha -- were arrested in late 2001 on the Afghan-Pakistani border and sent to Guantanamo.
They were allowed to return to France in 2004 and 2005 and were detained for periods of between 11 and 17 months.

A lawyer representing two of the men, William Bourdon, said judge Clement's request to US authorities was "without precedent and should enable us to identify those responsible for this arbitrary detention and torture."
There will probably be more countries asking for justice for their citizens. The US should have taken care of this and countries like Spain did wait until Bush was out of office to give the US an opportunity to do so it is clear this will not happen now. But the victims are all over the world, and until justice is done, this will not go away.

(26,293 posts)instantly or that everything would be all right if only we isolated ourselves from the rest of the world (and yes it was tried and it failed horribly).
All I am trying to say though is we need to work together to find some common ground and solve the problems we are facing in this country and tell the ones who keep up the "our way or the highway" shtick that they need to get the hell out of the way.

There are splits both within and without the religious communities of America,
there are splits politically, primarily Republican vs Democrat, but a few more are gaining ground
there are splits due to economic injustice and inequality
there are still splits due to race and ethnicity or nationality
I agree it would be nice if there were a United States feel to us, but as long as I've lived, it hasn't existed that way. In some areas it's better, in some much worse, but never absent, not since Reagan, which is when I was old enough to be paying some attention.

You can "need' and "should" all you want, but since it isn't reality it isn't helpful to a solution.

Seems Obama is fine with ignoring a lot of things like poverty, homelessness, hunger, crimes by Wall Street, banksters and the bushes. Yet, he just can't bring himself to ignore the Spanish judges and let them prosecute American elite war criminals.
Yeah, it would be so much like having a magic wand.

Or maybe america is just for the wealthy, since they have more money to spread around to their favorite politicians. Now days, much more money, than the plebes have to buy a voice.

I remember a candidate named Obama talking about protecting whistelblowers. President Obama turned around and is now prosecuting them more than any previous President, including Bush.

(82,849 posts)I was assured in no uncertain terms that these investigations were nothing more than a show, a scam, and judicial activism at its worst that would lead nowhere and accomplish nothing. Paying attention to them was just foolish, and a legal wild goose chase. And yet, here's the mighty United States, doing what it can to subvert, short circuit and obstruct the cases. Which are like, totally meritless.
Very, very odd to see the actions not quite match up to the rhetoric.

There are so many of us who have been protesting, writing and visting our Senator's office. writing letters to the editor.. etc.
so much time and work to demand an investigation, and prosecution.
We have to keep up pressure on.
