Letitia James Wants to Block Trump From Leaving New York

Source: Newsweek

Published Feb 22, 2024 at 11:53 AM EST Updated Feb 22, 2024 at 1:55 PM EST

New York Attorney General Letitia James is asking a judge to block Donald Trump from changing his business address from New York to Florida, arguing that his executives "carry out the business activities" of the Trump Organization at Manhattan's Trump Tower.

In a Thursday letter, James urged Judge Arthur Engoron to "reject Defendants' attempt to change the business address of the six entity Defendants to Florida as the record establishes those entities are located in Trump Tower at 725 5th Avenue in New York, the office building in which the executives who carry out the business activities of those entities work."

Trump owes New York state almost $454 million, including interest, after a civil fraud trial on charges that he inflated his wealth on financial statements to deceive banks, insurers and others. Engoron handed down a nearly $355 million verdict last Friday, but that figure goes up $87,502 every day that the former president doesn't cover the bill. James has said she plans to seize some of Trump's assets if he fails to pay.

"If he does not have funds to pay off the judgment, then we will seek judgment enforcement mechanisms in court, and we will ask the judge to seize his assets," James told ABC News on Thursday.

Jay Ritter, a finance professor at the University of Florida, said the windfall is “paper wealth … with the emphasis on ‘paper,’ since his [Trump Media] shares cannot currently be sold.”

Trump Media’s key stockholders, including Trump and its management team, agreed to a common financial provision, known as a “lockup” period, that prevents them from selling shares for six months after the merger unless Digital World waives the agreement, according to a Digital World filing. If the merger occurs in April, for instance, Trump would not be able to sell his shares until October, at which point their value may have changed considerably.

Ritter said that in his opinion the merged company’s valuation — roughly $9 billion, based on Digital World’s current price — is out of sync with the Trump company’s financial performance. Trump Media generated $3.4 million in revenue and lost $49 million during the first nine months of 2023, Digital World said in a recent SEC filing.

Trump Media is “a money-losing company that generates less than $5 million per year,” Ritter said. Digital World, he said, is in his view “a classic meme stock, whose price is totally unrelated to the underlying fundamentals.”

Time will tell, but I don't expect the valuation to be anywhere close to that when all is said and done and it's a sellable stock.

six months after going public will be based on political factors, not just traditional market forces.

You tell me with a straight face that, for example, TFG supporters with billions to waste won't do exactly that in order to circumvent campaign contribution limits. Candidates you likely know may spend unlimited amounts on their campaigns.

Further, while the actual shares may not be sold for six months, earlier financing could be achieved with loans against expected future values as well as selling call options.

If Trump loses in November there's going to be little value to 3rd tier social media company run by a two-time presidential loser.

I'm not sure who would loan on the shares value when that value hinges completely on such a volatile factor.

A possible residual stock value just makes this type of investment (contribution) even more financially attractive. I can imagine Musk buying $10B. If it's ultimately worthless, he doesn't seem to mind that much. If it's $10B worth of influence with an additional $5B stock value (presuming a 50% drop), then so much the better.

Her money is his money while they are married, and visa versa. Doesan't matter what pre or post nup agreements exist, marital assets are common.

There are some types of trusts that can survive bankruptcy and civil suits, unless it is for a specific type of verdict, which fwiw, the defamation case is.

So her money is up for grabs as soon the easy to find funds are gone.

Suck it up mel......

Am guessing this means the liable defendants - 45 & family and a couple others - may try to claim they "don't work in NY at that address and work in FL" instead.

I think he wanted that 30 days to move these corporations addresses and associated bigwigs to Florida, in order to plead they're no longer NY entities. And of course, de Santis would have smoothed the way for whatever he wanted. Good on Letitia James and the Judge on keeping up and thinking through his criming machinations. I sure couldn't do it!

I never imagined that in the 21st century we'd be a country of crooks to this extent. Although, I recall after the 2000 election exposed GW Bush cheating at Yale, there was a book about us as a "cheating culture".

"A public policy expert reveals how decades of deregulation and increasing inequality have fostered a culture of cheating across America."
