French court lifts ban on growing Monsanto GMO corn

AFP - France's top administrative court on Thursday threw out a government ban on US agro-chemicals giant Monsanto from growing a type of genetically modified corn.

A moratorium on MON810 corn -- one of just two types of genetically altered food crops whose cultivation is approved by the European Union -- has been in place in France since March 2012.

The Council of State court noted in a statement that the moratorium had little legal basis.

It pointed out that EU regulations say such a ban "can only be taken by a member state in case of an emergency or if a situation poses a major risk" to the health of people or animals, or to the environment.

This move was ordered, according to AFP, by the Council of (the French) state:

"Faisant application du droit de l’Union européenne, tel qu’interprété par la Cour de justice de l’Union européenne, le Conseil d’Etat a annulé l’arrêté du ministre de l’Agriculture du 16 mars 2012", indique le Conseil d’Etat dans un communiqué.

(Applying European Union law, as interpreted by the Court of Justice of the European Union, the Council of State has voided the injunction of the Minister of Agriculture of March 16th, 2012," indicates the Council of State in a communiqué.)

How odd that France finds it perfectly to ignore European law when it comes to terrorizing its small businesses, but finds it necessary to apply European law strictly when it serves the interests of some big conglomerate (and harms its population.

I bet my French friend that there were more than a few members of the Council of State who recently (and most unexpectedly) inherited, from long forgotten rich uncles, houses located in Monaco, Brazil and Hawai'i.

He said he never took a bet when it was guaranteed from the start that he'd lose.

My wife is horrified as well, as there is no border station where the wind can be checked for Frankenfood seeds when it blows from France to Germany.

to "interpretation." sigh..... It's just devastating that Monsanto wormed its way in there. It was many of our hopes that EU ban would hold.
