BOSTON (AP) - Dzhokhar Tsarnaev's lawyers may try to save him from the death penalty in the Boston Marathon bombing by arguing he fell under the murderous influence of his older brother, legal experts say.

The outlines of a possible defense came into focus this week when it was learned that Tsarnaev's attorneys are trying to get access to investigative records implicating the now-dead brother in a grisly triple slaying committed in 2011.

In court papers Monday, federal prosecutors acknowledged publicly for the first time that a friend of Tamerlan Tsarnaev told investigators that Tamerlan participated in the unsolved killings of three men who were found in a Waltham apartment with their throats slit, marijuana sprinkled over their bodies.

The younger Tsarnaev's lawyers argued in court papers that any evidence of Tamerlan's involvement is "mitigating information" that is critical as they prepare Dzhokhar's defense. They asked a judge to force prosecutors to turn over the records.

let him live each day knowing that's all it is for him. his 21st birthday will be in prison, he will have decades more in prison. nothing else for him.

Was it possibly an accident or definitely homicide? Do you know what the evidence on that is? I haven't followed this enough to know.

or not. If someone dies in the commission of a crime, the partner is held liable for the murder. If Jack and Ryan are robbing a store, and Jack gets shot by the clerk, Ryan is charged with the murder, because the robbery is the reason Jack is dead.

And if so, isn't that a defense in the making?

I'm all for giving him some kind of chance. He is young and was probably led by his brother. Nothing we can do will bring back those killed but maybe we can salvage this kid. (Yeah, i know, call me a bleeding heart liberal!)

hero worship of a sibling is not a defense to criminal charges, AFAIK.

I idolized my older sister. Luckily for me, she was about as far from murderous as a human can be.

I oppose the death penalty, so I hope he gets life, if found guilty.

and, like with the other thread, the "news" is no news at all. The fact that Todashev allegedly confessed that he and Tsarnaev committed the Waltham murder (just to being shot at seven times before signing the confession, one shot in the back of his head) has been known for months.

These alleged news is an obvious campaign to take influence in the ongoing Tsarnaev trial and covering the scandalous case of Ibragim Todashev. Brainwash alert.

planting the bombs that killed people and shredded the bodies of so many, he chatted casually with college buddies about it before heading out on another spree with his older brother, he bragged about being the Marathon bomber to the car jack victim after they had killed a cop to get more weapons, then they had a shootout witnessed by many cops and people in a residential neighborhood, and finally the wounded suspect was captured hiding in a backyard.

Yes, it will take a court to lay out all of that evidence to prove he is guilty to some jury, but that murderer is hardy innocent.

with no running around making calls, making friends, giving interviews, writing a book or even having a tv. I hope for those maximum security prisons where you get to do nothing social. Some people actually like spending their lives in prison.
