NY judge throws out suit by photographers challenging border searches of laptops

NEW YORK, N.Y. - A New York City judge has thrown out a lawsuit by a photojournalism organization and others challenging laptop computer searches at U.S. borders.
Judge Edward Korman granted the government's motion to dismiss the lawsuit on Tuesday.
Civil rights lawyers had sued in Brooklyn federal court in 2010 on behalf of the National Press Photographers Association, criminal defence lawyers and a French-American student whose laptop was confiscated at the Canadian border.
The plaintiffs alleged border agents are violating civil rights by searching laptops at U.S. borders without reasonable suspicion. The judge disagreed, citing appeals court rulings finding that reasonable suspicion isn't required for border searches.
An attorney with the American Civil Liberties Union says the organization is considering an appeal.

(6,241 posts)that the test of the legality of something is "Does the government need to do this?" instead of "Is it Constitutional for the government to do this?"
They could do anything they wanted to without limits, as long as they can demonstrate a "important governmental interest".
And this isn't about stopping terrorism or protecting lives or property. It's about control over journalists.

(22,000 posts)a tourist, or a citizen (or all of the above). They can go through any electronic device. I had this happen to me in December 2004 when going through SFO. It delayed me an hour as I had photos from my first year in Korea and a short trip to Thailand. I am now reluctant to bring a laptop back into the country just because it will be such a hassle when going through customs.
