Mumbai Gang Rapists Are Sentenced To Death

Three assailants in a notorious gang rape at an abandoned mill will receive the death penalty, while a fourth was sentenced to life in prison.

An Indian court on Friday delivered a sentence in the brutal gang rape of a photojournalist in Mumbai, ruling that three convicted rapists shall receive the death penalty and a fourth attacker shall spend the rest of his life in prison.

The three men who were sentenced to die today — Kasim Bengali, Vijay Jadhav and Mohammed Salim Ansari — were also convicted in a separate rape case last month, where they received life sentences. Both assaults took place at Mumbai’s abandoned Shakti Mills.

“The gang rape accused were not only enjoying the act of sexual assault but also the survivor’s helplessness. It was executed in the most gruesome manner with no mercy or show of human dignity to the survivor, ” said Judge Shalini Phansalkar-Joshi while reading her sentence, according to the Hindustan Times.

The death sentences are the first under harsh new guidelines for repeat rapists, passed in India following public outrage surrounding the 2012 rape and murder of a 23-year-old medical student in New Delhi.

Too many years of lax police enforcement had taken its toll and it is about time fear is instilled in the minds of would-be rapists.

There was a study I saw where 25% of rape accusations were declared unfounded by the police in the United States. The FBI looked over the cases and only 8% actually fell under the guidelines for unfounded accusation. Even those guidelines are a little loose for my liking.

Then there's the revelation that there are 400,000 untested rape kits in the United States.

I could not make the link work but I wonder if it matters whether the rapes are gang rapes or a lone rapist. I can see that the death penalty may not deter lone rapists because they are usually not as likely to get caught as often as gang rapists. Gang rapes tend to be more public and get talked about more by the rapists themselves. That said, personally I am not in favor of the death penalty for anything but I do think that life without parole is appropriate in many cases of both rape and murder to protect the public.

in murders of passion or in robberies where the loot is massive. But for cowardly crimes like petty theft and rape, it is probably very effective. I know it will be a major deterrent in India once people realize that they can't get away with it like they used to.

If the punishment for rape is the same as it is for murder, why not get rid of a witness? Particularly if the victim is the ONLY witness.

India has few lone rapists and most of the rapes are done by groups of men who are either drunk or just squeezed by peer pressure. There are always witnesses and the weakest link usually cracks under pressure and fingers the others. Murdering the victim is not an option to escape punishment.

If you have ever been to India, you'll know that except in extreme rural areas, it is impossible to be completely alone in any public place and someone will see one commit a crime.

Rape is still not very common as a crime in India as compared to other countries. You see more of it in the news because of purposefully heightened media awareness to shame the police into enforcing the laws after the Delhi case in December 2012.

One gang rape attack in India occurred soon after massive publicity of the arrests in the earlier attack.

A few well-publicized hangings and rapes will drastically go down in incidence. They won't go down to zero but I'll take a drastic decrease over perfection every day.

This is a good start. I normally don't like the death penalty, but I make exceptions for sexual predators and serial killers. It is nearly impossible to rehabilitate these people and you can't keep them in prison for life, because they will either harm other prisoners, or become victims of prison violence themselves. I see the death penalty in these cases as the same as putting down a rabid dog.

Raping the rapist, murdering the murderer. But no work on the underlying religious and cultural underpinnings of the practice. No focus on the education of young men to teach the abhorrence of the act. Relying on human fear to somehow make them into better people -- why, it worked back in the 1300's, right?

Insufficiently complex thinking is the fucking devil.

Poor rapists are going to DIE! First some poor, pitiful serial killer has to die in Texas now rapists in India. What's the world to do???? These beautiful criminals have FAMILIES! They will be so sad to lose their loved ones. We all know that killing these people won't bring back those ugh, ugh, victims...... and their families have already adjusted just fine to their deaths, just the way the world works (and they had better have forgiven them or we won't stop demanding it). Oh but the CRIMINALS!

I doubt they would last very long in prison anyway. I think some other gang rapists committed suicide in prison.

Let this be a deterrent.

The victims still have hope to recover and live a happy life, but the trauma will always be with them.

This case was very, very violent.

Those victims will spend their lives dealing with a tragic event. And have suffered. I'd like to have those guilty sit in a cage. Dead men know nothing of consequences. Even if they never felt shame or guilt, they would feel the loss of freedom.

which is why I am against it in all cases.

I don't see too many death row inmates just resigning themselves to death--they fight it tooth and nail. Life in a cage is better than none, it would appear.

If no innocent person was ever killed--go for it. But that is not possible.
