Federal appeals panel stops same-sex marriages (Indiana)

A federal appeals court issued an emergency order late Friday stopping same-sex weddings in Indiana pending the outcome of an appeal of a federal judge's ruling that the state's ban on gay marriage is unconstitutional.
The order came just hours after Attorney General Greg Zoeller turned to the 7th U.S. Circuit Court of Appeals in Chicago to stop the marriages that have been conducted across the state since Wednesday.
The emergency order stops same-sex marriages but leaves many unanswered questions about the status of couples married prior to the stay.
Marion County Clerk Beth White, who took an early role in granting licenses and conducting civil ceremonies Wednesday, announced Friday after the stay that her office would stop doing so.

(34,582 posts)that found that the 35 foot buffer zone around abortion clinics was unconstitutional- I wouldn't hold too much hope on them doing the right thing.

(45,806 posts)early this year I think, almost all the federal judges gleened that the majority of the scotus agreed this issue was unconstitutional. I doubt they are all wrong.

as did King Canute's order to the ocean to stop coming in .....
Gay marriage will be the law of the land very soon.
BTW as a straight man I just don't get why anybody should be
worried about "the gays" getting married.

(109 posts)When someone doesn't like something or someone, they will never settle for changing the channel. Nothing short of launching it into the sun. If they care enough to say something, it needs to be wiped from the face of the earth.
So whenever you're asking this question, just full in " it exists, and I don't like it"
If we wiped religion from the face of the earth, far fewer people would have issues with this, as most of the roots of gay hatred are there, be they newer or more ancient ones.

(30 posts)The roots of homophobia aren't in the religion, they predate the religion. The book(s) have homophobic passages because there were homophobes back then, too, and they helped write the book(s), partially to justify and enshrine their prejudices.

(1,968 posts)stays were only granted if the other party was going to be noticeably harmed if the court order went through. In this case, I fail to see the harm, other than butt-hurt, which doesn't count.
Ah, it would be nice if the law were the same for everybody, but we already know that's not true.
As of this particular moment, I have a one finger salute for the 7th, and all the other courts that have stayed these decisions (often after painfully short windows of opportunity for desperate couples).

(22,000 posts)Granted I disagree with them and would like more than anyone to see them dropped. What is going to take is several appeals going to SCOTUS and a major decision that resolves all of the cases.

(8,738 posts)the legal rational for these type of stays from the court. What sort of legal cause does someone give for the court to order a stay on appeal? "I need a stay so I can appeal because "the gays" getting married will...." whatever the nutjob reason is supposed to be. Where is the proof of personal harm and cause that can be given to stop marriages? Is this something that automatic? Otherwise I don't understand the reasoning.
