Fla. judge orders special session to redraw congressional map

TALLAHASSEE -- -- Circuit Court Judge Terry Lewis ruled Friday that the Florida Legislature must immediately revise its congressional map and gave it until Aug. 15 to submit a revised map.
Lawyers for the Legislature had argued that fixing the map before the November elections would cause horrific uncertainty for voters and would be an extreme, unnecessary remedy. He ordered a hearing for Aug. 20 to review the proposals.
Lewis ruled last month that the states congressional redistricting maps are invalid and declared two of the statess 27 districts unconstitutional those held by U.S. Reps. Corrine Brown, D-Jacksonville, and Dan Webster, R-Winter Garden.
But the Legislature decided not to appeal the ruling. House Speaker Will Weatherford and Senate President Don Gaetz then urged Lewis to let them revise the map after the November elections to avoid disrupting the fall elections and to comply with federal voting rules that impose a fixed schedule for sending ballots to overseas voters in the military.

A Florida judge is ordering legislators to hold a special session to draw up a new congressional map for the state.
Circuit Judge Terry Lewis on Friday ruled that the Florida Legislature must draw up new congressional districts by Aug. 15. Lewis said that he will then order a special election later this year for those new districts.
Legislative leaders had wanted to keep in place the state's current districts until after the 2014 elections. Lewis has already previously ruled the current districts are illegal because they were drawn to benefit the Republican Party.
Voters in 2010 passed the "Fair Districts" amendment that says legislators cannot draw up districts to favor incumbents or a political party.

(3,596 posts)I couldn't see how this could be accomplished in such short time. In fact I suspect the special election will not be held until sometime in Q1 of 2015.
First the legislature has to draw up the new districts. The court gave them 2 weeks to do this. That is not sufficient time in my opinion. Just because they gerrymandered the districts before doesn't mean we should try to cram a fairly complex process into two weeks. I would rather they take some time to develop districts consistent with the "Fair Districts" amendment. I don't know if those then need to go the governor for his signature before they go to the judge for approval or after.
But that process should not be rushed. Further voters have to be advised which district they are in, voters rolls, etc. adjusted for the new districts, etc. This takes some time.
The November elections will proceed based on the current gerrymandered districts. Those Congressmen/women may even be sworn in in January only to be removed from office after the special election.

(18,652 posts)Dividing into smaller districts for large watersheds is not impossible, either. Upper, middle and lower watershed districts could be one way to subdivide.

(26,184 posts)The Legislature has shown following the Supreme Court's order in Apportionment I that it is capable of adopting and submitting a remedial map very quickly when time is of the essence. Indeed, I would be surprised if it's (the Legislature's) staff has not already prepared alternatives for considerations by members.

(3,596 posts)Even he realizes the "process" will not be over by November that is why he says there will have to be special elections.
The judge is really stupid if he thinks these new districts will be drawn in 2 weeks. They won't be and if they are they will be as bad or worse as the last ones. I can see the FL legislature just continuing to throw him bad map after bad map. In the meanwhile the congress critters in Washington are dismantling our county.
Trust me, the fact the legislature says they aren't appealing means nothing. I don't even think the legislature has standing. Normally the state AG represents the state so I won't even conclude there won't be an appeal.
Even if there is no appeal the FL legislature are not giving up. There will be no immediate changes.

(94,594 posts)...These days, computer software can quickly allocate all population units into equitable and balanced districts in a couple of hours.
What can't perhaps get done is addressing the inevitable appeals and requests to tweak the boundaries.

John Mica (R-Fla.), Dennis Ross (R-Fla.), Ron DeSantis (R-Fla.) and others could all potentially see line changes that could put them in much tougher races, though the GOP-controlled state legislature that's in charge of the new lines will likely seek to do as little damage as possible to their incumbents' chances.
The decision could also force a number of districts to reopen election filing, which might give Democrats another crack at finding a candidate to challenge freshman Rep. David Jolly (R-Fla.), though it's unclear whether his district will be touched.
"It's pretty clear Democrats are going to benefit. How much is the question," said one Florida Democrat who's been closely following the case.

(16,066 posts)Everyone assumes the seat held by Corrine Brown is drawn to assure a minority rep is elected. And it does. But the hidden truth is that it also assures 3-5 safe repug seats.
My useless piece of shit Congressman Ander Crenshaw, that directly borders Ms. Browns district, is so safe he is running unopposed again.
This will upset the apple cart for him.
