Michigan man is freed after 15 years; DNA fingers other man in murder

Jamie Peterson, who was once sentenced to life in prison for the rape-and-murder of an elderly northern Michigan woman, was released from jail today for the first time in many years.

Peterson, 39, had his 1998 conviction tossed out last month, thanks to new DNA testing prompted by a team of lawyers who argued that Peterson is innocent in the slaying of Geraldine Montgomery of Kalkaska. One of his lawyers, Caitlin Plummer, picked up Peterson about 12:30 p.m. today from the Kalkaska County Jail and they stopped at a Wendy’s for a cheeseburger, fries and a shake.

“So, he enjoyed that,” said Plummer, of the University of Michigan’s Innocence Clinic. “He’s just real happy, big smile on his face. Everything is still pretty new, but he’s taking it all in and enjoying his freedom so far.”

A judge threw out Peterson’s convictions after lawyers from Michigan and Northwestern University successfully argued that new DNA testing points to another man, not Peterson. That man, Jason Ryan of Davison, was arrested late last year and is awaiting trial.

Also all these false confessions they secure leave real killers on the street

These cases are the biggest argument for abolition of the death penalty in the rest of the country.

We have never had the death penalty. I would rather hang than spend my life in Jackson State and that thought is why we don't kill "killers".

Michael Perreault, the Kalkaska County prosecutor, agreed to not pursue a new trial for Peterson if all sides agreed to send him to a supervised facility for sex offenders. Plummer was taking him to such a location, which is being kept confidential.
