Drug case dropped over Ferguson officer no-show

CLAYTON, Mo. (AP) A felony drug case involving the Ferguson police officer who killed an unarmed 18-year-old in a separate incident has been dismissed after the officer twice failed to appear in court.
The St. Louis Post-Dispatch (bit.ly/1tdq22A ) reports that a St. Louis County judge on Monday dismissed a felony marijuana possession charge against 28-year-old Christopher A. Brooks. The judge had agreed to put the case on hold after officer Darren Wilson missed a late September preliminary hearing.
Wilson also didn't appear before a grand jury in the Brooks case, an alternative that Associate Circuit Judge Mary Bruntrager Schroder signed off on at the previous hearing.
Wilson received a Ferguson City Council commendation in February for his role in Brooks' arrest one year earlier

Your job is to DISORGANIZE what exists, and THEN organize what you want.

This is a small but great example of that. The regular business of the city has been interrupted, and they are having trouble carrying on their regular business.
According to the LA Times, "Wilson has not been seen in public since the shooting -- including at the preliminary hearing in Clayton, Mo., on Monday for a man he arrested in 2013."
Good. Time for more pressure, see if they can do that with a few more things. I hope this is part of their strategy, and not just a coincidence. If it is just a coincidence, I hope the community recognizes it, can use it to their advantage.

(10,952 posts)It was the sixth low-level drug case connected to Wilson to be dropped in recent weeks, according to information from Ed Magee, spokesman for St. Louis County Prosecuting Attorney Robert P. McCulloch.
Brooks lawyer, Nick Zotos, said Wilson was not under subpoena, and while on administrative leave could not be compelled by the department to appear in court.
St. Louis County Associate Circuit Judge Mary Bruntrager Schroder had given prosecutors until Monday to get Wilson to the grand jury an alternate path to advance the case to trial. Her order Monday says simply, State not ready. Cause dismissed for failure to prosecute. State opposed.
In August, Brooks predicted in a Facebook post, since deleted, that the charges would be dropped. He also claimed that Wilson had beat him while he was handcuffed.

This may help in the Civil Case, should Brown's family chose to sue Wilson. It might raise credibility issues regarding Wilson.

(5,082 posts)There should be no such thing as a felony marijuana arrest. The crime is fleecing the public and oppressing them by making a harmless, healing plant illegal.

(13,069 posts)Not unusual at all for officers on leave to fail to appear for a hearing/trial. If they are not served, they are not compelled. He may not have even known about the date of trial.
