NYC adult home residents asked to repay FEMA aid

NEW YORK (AP) — The residents of Belle Harbor Manor spent four miserable months in emergency shelters after Superstorm Sandy's floodwaters surged through their assisted-living center on New York City's Rockaway peninsula.

Now, the home's disabled, elderly and mostly poor residents have a new headache: The Federal Emergency Management Agency has asked at least a dozen of them to pay back thousands of dollars in disaster aid.

Robert Rosenberg, 61, was among the Belle Harbor Manor residents who recently got notices from FEMA informing them that they had retroactively been declared ineligible for aid checks they received two years ago in the storm's immediate aftermath. The problem, the letters said, was that the money was supposed to have been spent on temporary housing, but that never happened because the residents were moved from one state-funded shelter to another.

FEMA gave Rosenberg until Nov. 15 to send a refund check for $2,486 or file an appeal.

The state then moved the residents, many of whom suffer from mild mental illnesses, to a halfway house on the grounds of a partly-abandoned psychiatric hospital in Queens, where they bunked on cots and were barred from having visitors in their rooms.

Rosenberg said the FEMA workers who urged him to apply for assistance during the period when residents were staying at the armory never explained that the money could only be used for housing. "Everyone asked, 'Do we have to pay this back later on? Is it a loan?' They said, 'No. It's a gift from Obama,'" he said. "If I wasn't eligible, then why give it to me in the first place? They knew we were living in an adult home. They knew our shelter was being paid for by the state. It's not like we lied on the application."

Lawyers at MFY Legal Services, a legal aid group that has worked with adult home residents in the past, have offered to help Belle Harbor Manor residents with their appeals.

"Our position is that it would be an unbearable financial hardship and unjust," to require the residents to repay the money, said MFY attorney Nahid Sorooshyari.


These were extremely stressed out victims, many of whom had "mild mental illnesses". And FEMA should have been able to determine the state was paying for housing. It was a crazy hectic time, and in emergencies like this, FEMA relies on its' temporary employee/part-time cadre of workers, who come in from out of state and put in long hours. I'll give the FEMA field workers the benefit of the doubt they were trying to help and made an honest mistake re this adult housing facility. The bureaucrats in DC need to eat the losses on this one.

What is fair about our Fed Govt. They allow Christie to steal and misspend tens of millions met for Sandy Aid and he goes scott free.

Where the heck is Mayor DiBlasio, Governor Cuomo, and Senators Schumer and Gillibrand, and the multitudes of other Democrats in NYC, NYS and the federal government?

What moron at FEMA thought that this was a good idea or would end well for the agency, and was anyone in the White Hose paying attention?

However, on the bright side, I expect a fully bipartisan effort to demonize FEMA and the White House until they "reconsider their position in light of new information and evolving circumstances."

However, I truly cannot understand how anyone at FEMA thought the invoices were a good idea, and if legally mandated, how the demands could be so callous and politically tone deaf.

If you want to prevent criticisms from morons like Rand Paul, step one would be not making monumental screw-ups like demanding innocent elderly and disabled Sandy victims from repaying aid.

Senator Rand Paul says the obligation of society to care for its less-well-off population is a form of servitude and government overreach.


“As humans, yeah, we do have an obligation to give people water, to give people food, to give people health care,” Paul allowed, “but it’s not a right because once you conscript people and say, ‘Oh, it’s a right,’ then really you’re in charge, it’s servitude, you’re in charge of me and I’m supposed to do whatever you tell me to do.”

If you’re such a rugged individualist that you view humane society as a burden or form of servitude, I don’t believe you have any business serving as a member of Congress or even the city mayor. And this call to free ourselves from the chains of the SNAP and Medicaid programs comes in the form of a pitch for his medical practice which, I’m guessing, probably relies on customers receiving some form of government aide to stay in business.

If you can get over your contempt for Rand Paul for a moment, a feat I struggle with, you may realize this is somewhat amusing in that a man who may be a Republican presidential contender in the near future believes access to food and water are not a right.

I could see today’s Republican base running away with that idea, but I don’t think the party establishment will like the results at the ballot box.

If the world was sane, this would be the end of the Rand Paul campaign:

A new video today catches Rand Paul repeatedly supporting a $2,000 Medicare deductible on Kentucky seniors – despite his claims just last week that such a statement was a “lie.”

Because it's important the elderly people with dozens of health problems be more responsible with their health care dollars. We certainly can't expect people like Dr Paul to
take that role. After all, they "deserve to make a comfortable living" and can't be expected to ensure that these frail old people aren't overusing the system. These "greedy geezers" need to take more responsibility for themselves and maybe a little of that Paulite "tough love" will snap them into reality.

By the way, the average social security check is $1,000 a month.

No one here is suggesting that Rand Paul's ideas are good, and it's not a competition between FEMA and Paul as to who can make more politically stupid decisions.

Simply, FEMA made a colossal political mistake. It does not matter if the criticism comes from Bernie Sanders, Elizabeth Warren, Rand Paul or Ted Cruz, they would all be right.

More importantly, a fundamental underpinning of Democratic governance is that government is a competent force for good. The Sandy invoices to the elderly and disabled is the exact opposite of that message, shows lack of leadership and competence from the White House, and sadly will be used by individuals like Rand Paul to attack Democrats. The solution is not a diatribe about the evils of Rand Paul, but to ensure that such government stupidity is not repeated.

Collectively, those residents had received $108,598, with most of that money intended to cover temporary housing. Five residents had also received aid to cover destroyed belongings."

Mistakes are made in a huge government agency.. Look at all the good FEMA has done, too. Hopefully this will get sorted out in a positive way for the residents of Belle Harbor Manor!

I can assure you that criticisms of FEMA over this mess will be bipartisan from the far right to the far left.

It likely was the result of political tone deafness from FEMA combined with inadequate oversight from the White House.

We always have money to throw at bombing people in the Middle East. But it appears we get that money from dunning the disabled. It makes me ashamed to be an American.
