Detective wanted arrest warrant for NBC's David Gregory

The controversy over former NBC anchor David Gregory's display of a high capacity gun magazine got new legs this week.
An affidavit shows a Washington Metropolitan Police Department detective requested an arrest warrant for Gregory, according to Conservative website Legal Insurrection. In December 2012, the then host of NBC's "Meet the Press" broke the district's laws by waving the 30-round ammunition magazine at the network's studio during an interview...
...According to the affidavit, a NBC editor exchanged several e-mails with authorities who informed the editor that possessing the magazine would violate the law and be a misdemeanor. Police recommended using a photo instead of the magazine during the interview.
Gregory later displayed the magazine. In response, police investigated the incident. And, Wayne Gerrish, a Washington Metropolitan Police Department detective, requested an arrest warrant for Gregory. It was declined in January 2013.

Naturally it was declined- Gregory could be trusted with that magazine, he's not
one of "those people..."

(18,636 posts)At one point in our conversation he said the most sensible thing I ever heard an officer say: "Intent is everything when I consider an arrest".
Technically Gregory broke a law meant to protect citizens, but he obviously wasn't intending to hurt anyone. It was basically a prop. What purpose would be served by hauling him out in 'cuffs?

I'm not a fan of "Stretch" by any stretch of the imagination, but to me there seems to be a lack of common sense in seeking a criminal trial for this. Sounds like this cop has the kind of Joe Friday stick up his ass that could land his mother behind bars if she forgets to renew her license.

(18,636 posts)As a gun owner myself, I understand that switching mags takes so little time when everyone has their heads down that murder rates will likely be unaffected by banning them, but I also understand the cosmetic issue. It's harder to be terrified of gangs if they're armed like Elmer Fudd. hahaha

Let me ask you this:
Should anyone posessing one of these things that isn't hurting anyone- IOW, committing
a crime with a gun- get similar leniency?

(18,636 posts)If someone has an extended mag laying on the floor of their car during a traffic stop at 2:00AM they may deserve further investigation. Some network tool displaying one to spur a studio discussion isn't even close to that level of suspicious behavior.
Such discretion is why RoboCops are only good for traffic light enforcement, and even then...

Duh.
Why people are confusing intent to posses with intent to do harm is beyond silly. Nothing in the law stipulates you have to be intending to do harm for possession to be a violation.
One wouldn't guilty of possession if the magazine was slipped in to your back pack without your knowledge. On the flip side, one would be absolutely guilty if they ordered the item on line and paid with a credit card and was found with the item in their collection with all their other toys.
Sure it's a gray area where a reporter doing his job is involved. Big fucking deal. We give the press conducting a story more latitude. Always have.
Now I have to go throw up for calling "Stretch" the press.

(1,254 posts)was to punish Dick Gregory. I think he was trying to retaliate against the law restricting this magazine. He and his gun nut buddies can't have them, therefore, why should Dick Gregory have possession of one. It tit for tat mentality and retaliation.
