As a conservative, I believe that facts and circumstances matter, and often complicate simple rules. A sheriff or magistrate in New Hampshire in the late 1850s would have been justified in choosing to look the other way rather than enforce the Fugitive Slave Act. Some Northern juries flatly refused to implement that law.
But those were choices made at the foggy extremes of political theory. Whatever your view of Justice Anthony M. Kennedys ruling on marriage, granting a wedding license is not in the same category as participating in a legal system that supported chattel slavery ...

They waved signs like Kim Davis for President ... The crowd in itself is not newsworthy you can get 300 people to support pretty much anything ...

The Christian Scientist clerk at the IRS cannot audit your taxes because you chose medical help. Practice your religion in freedom; just dont make everyone else practice your religion ...
Its pointless to question Davis sincerity, because theres no way to determine whether shes a pious zealot or savvy businesswoman looking to cash in on her notoriety ...

She was order by a court to perform her duties as prescribed to her in the oath of office that she took, voluntarily, and she isnt doing so. Thats contempt ...

Among the 35%, a large number will support the rule of law
There's no advantage to being an ideologue: Davis wouldn't be in jail right now if she'd refused to issue licenses herself but allowed her deputy clerks to issue them

Lets get one thing clear. Rowan County Clerk Kim Davis wasnt jailed on Thursday because of her religious beliefs. She was jailed because she is a government official who refused to follow a legal and direct order from a federal judge designed to protect others' constitutional rights.
Its a classic case of a local authority disagreeing with federal courts and trying to push back only to lose in the end.
It happened when Arkansas Gov. Orval Faubus called out the National Guard to keep black students out of Little Rocks Central High School nearly 60 years ago.
President Dwight D. Eisenhower, a Republican president who understood the rule of law, ended that fiasco when he federalized the Arkansas National Guard troops and sent them back to their barracks. He then sent in 101st Airborne to protect the African American students ...

We dont need to mock Davis for justice to prevail. If we are to live our message, that all marriages are equal, then Id rather treat her with the respect she has denied others. She can believe whatever she wants. Same-sex marriage is the law of the land, including in Rowan County.
Davis is a flawed human, and in that, she has a lot in common with the rest of us ...
I do, however, want to know why it is that the meanest of my fellow Christians claim they get their marching orders from God while the decent ones just keep acting like Jesus, loving everyone as best they can ...

Kentucky Constitution: Section 228 for all offices.

But it doesn't matter. Nobody is forcing her to issue licenses. She's in jail because she refuses to allow her deputy clerks to issue licenses. Not all deputy clerks are willing to issues licenses; and the one who won't (her son) isn't in jail either
It's easy to understand: she currently gets out of jail just by agreeing to let her deputy clerks issue licenses
