Merrick Garland asked to probe perjury allegations against Brett Kavanaugh



Merrick Garland may play a role in the vacant Supreme Court seat after all. A liberal group has filed a criminal complaint against Brett Kavanaugh for allegedly perjuring himself in front of the Senate judiciary committee. Garland, who is the chief judge of the D.C. federal circuit, was asked to rule upon the complaint or appoint a special panel of jurists to investigate the allegations.

The Democratic Coalition, a group led by Jon Cooper and Scott Dworkin, claim that Kavanaugh lied under oath before the Senate back in 2004 and 2006 when he said he was unaware he read and used stolen emails in 2002. Kavanaugh was going through the hearing process in those years to become a federal district and appellate judge, respectively.

Sen. Patrick Leahy, who was on the Senate judiciary committee back in the mid-2000s, asked Kavanaugh if he was involved in the stolen email scandal while he worked in the Bush White House in the early 2000s. Kavanaugh said he was unaware that emails were stolen at the time, and insisted that if he did know, he would would have blown the whistle on his colleagues. Fast forward to 2018, Leahy, still on the Senate judiciary committee, introduced new evidence that suggested Kavanaugh handled emails that were stolen during that time period.

Those who wish to bring down Kavanaugh's nomination say that these new, unearthed emails demonstrate that the judge perjured himself during the past hearings.

As a side note, Salon would do well to clean their site up, there is so much pop ups, videos and garbage on there to make scrolling and reading the actual article very frustrating.

Just because Judge Garland has an axe to grind against the republicans who failed to even give him a hearing for the SC Justice seat doesn't mean that Kavanaugh DIDN'T commit perjury...

Ever time a bit of truth comes out it further tarnishes the reputation of Trump's future protector. As far as the Repugs are concerned, they are only concerned with retaining their absolute control of the crazy right-wing SCOTUS for decades to come.

I'm surprised IQ45 didn't appoint someone just out of law school. He'd have a minimum of 60 years to wreak damage on the U.S.--and particularly its citizens and environment.

The thing is, everyone knows that protecting his own ass is the sole reason Donnie Two Scoops appointed someone who was not on the list of Federalist Society approved candidates that he used to tout at rallies. The only different between Kavanaugh and those other equally qualified candidates is that K. has expressed the view that a sitting president is above the law.

he/they are just using stealth, his resignation was just a fig leaf but his and their judicial philosophies are the same.

Whether Kavanaugh is an "active" member or not; it's just six or half a dozen.

Kavanaugh was worried that if the press mischaracterized his ties to the Federalist Society it would suggest an "ongoing relationship" with the organization.

In the email chain Kavanaugh wrote, "the reason I (and others) resigned from Fed society was precisely because I did not want anyone to be able to say that I had an ongoing relationship with any group that has a strong interest in the work of this office."

Given his role in the White House of selecting judges himself, Kavanaugh, President Donald Trump's nominee for the Supreme Court, might have thought that the optics of being a member of the Federalist Society, an organization that has a distinctive conservative leaning with a special interest in selecting conservative judges to the courts, would hurt his credibility and image.

Despite what he told colleagues in 2001, when Kavanaugh filled out his Senate Judiciary Questionnaire on July 20, 2018, he wrote that he had been a member of the Federalist Society since 1988 without any gaps in membership.

Kavanaugh is proud of his Federalist Society membership and de facto there is no real daylight between him and them regardless of his active/inactive status with that group or whether they officially approved him or not.

criminal complaint, this is just a stunt by the Democratic Coalition, they've done this before and it's been dismissed every time.

Only municipal, state or federal prosecutors can file criminal complaints.

This is going nowhere, Judge Garland won't even see the complaint, the DOJ will review it and then circular file it.
