1) 40% of the people in the US criticizing evolution says more about the people in the US than evolution.

2) Theory means explanation (in the scientific sense). So saying, "Hey, it's just a theory" applied to Evolution means, "Hey, Evolution is just an explanation." On the other hand, Creationism is not an explanation, so don't call it a theory (of course, if you mean theory=speculation then go for it).

How evolution works is the theory. Creationism is religion being pushed as a science. But not having any facts to back it up, it can't be science.
