By the time police arrived, she was conscious again, and was refusing medical assistance.
The problem is that a minor cannot refuse medical assistance. She also would not call her parents or provide a number for them. The police then decided to engage in an ego contest with a teenager.

if she doesn't get her feet in the car then when the door is closed they spray her anyway sickening.

(62,444 posts)There were paramedics on the scene, since she had been knocked unconscious, and someone called 911. The driver of the car claims she had run a red light. The police were investigating the claimed incident.
A minor cannot refuse medical assistance. That decision has to be made by a parent or guardian. She wanted to leave.
So this devolved into an ego contest.
One could argue that the police would be liable if they let her refuse medical assistance, but concern for her well being does not seem consistent with their behavior, to put it mildly. She wanted to go home. A better course would have been to go with her, so that the circumstances could be sorted out with parental involvement. That, of course, would have inconvenienced the police.

(62,444 posts)I'm not sure I understand what you are suggesting. It would not have been at all difficult for them to go home with her, both making sure that she doesn't collapse from a head injury, and then determining whether the parents determined to have her looked at.
Additionally, should it also have been determined that she had run a red light, they could also have issued a citation at such time, given that they would also be certain of her place of residence.

(6,133 posts)But that was my experience working around white people. It is west of Frederick, which was a more tolerant place, and south from there...the commute is to DC.
As for the video, those police suck. A family friend, a Polynesian, worked for Hagerstown police for years. He is now a teacher. I don't know the reason he left. I would like to know his take on the video.
Now in America, the thing to do is pepper spray a 15 y/o girl for her own safety. She was already in the cruiser. It's like...I'll show her...squirt...squirt...squirt.

(397 posts)Hard piecing the story together due to MSM sensationalizing it. If she was in an accident and had a loss of consciousness, then she should be detained due to a high suspicion of traumatic brain injury. Cops are not equipped to make that assessment and should have transported her to a medical facility.

(3,963 posts)Right, but obviously she did not want to be transported anywhere. The entire thing was an attempt to get her into the car, really. Nobody used excessive force in that video, IMO.

(3,963 posts)When I read about it I was outraged, but after watching this I have to acknowledge that the policemen were quite professional in this case. She was pepper-sprayed after she was asked several times to keep her feet in the car so they could close the door and go. Charging her with anything is excessive though, as obviously she was confused and did not get that she had to be checked, even if she "felt" OK. Her reactions are natural, and the policemen did their best to manage the situation. Perhaps they could have tried harder to talk to her, but in the video it's clear that they tried many times to talk with her in a calm manner...

(3,963 posts)And I was not available right there to be with her, I would hope that somebody takes here to a medical center to be checked. And if she does not understand that is what needs to be done, yes, against her will. There was no gratuitous use of force here. She did not understand that she needed to be medically checked because she had hit her head and had been unconscious for 30 sec after falling.

Let's review:
She was profiled, grabbed, roughed up,arrested, handcuffed, forced to the ground (while screaming and sobbing) and put into a squad car, THEN pepper sprayed!
In the background you can see an ambulance and various EMTs, but they are waved off.
I'm no doctor, but I'm guessing that any potential brain injury is not helped by being physically roughed up and super stressed by the fear of what the three white officers may do next (like pepper spray an already handcuffed girl inside a police car)
The whole scene is disgusting, and would NOT have happened if the hapless girl was white, end of story.

(22,803 posts)The police should have a better way of handling the situation than pepper spraying her in the face. She was probably in shock after a concussion and should have been handled gently. I don't blame an African American teen for not trusting the cops. At the very least they could have followed her as she rode away on her bike to make sure she didn't have another accident, and to find out who she was. Patience and tact are not the strong suit of the American police force.

What I don't get is how the situation escalated as badly as it did. The girl was obviously confused and frightened. Agreed, the police were trying to manage the situation, and they were trying to do so without hurting the girl - but some of the things they said (e.g. that she was being detained for not cooperating) may have exacerbated things.

(3,963 posts)I watched the video of her speaking on ABC. Obviously, she was really frightened and she freaked out. On the other hand, when a bunch of big cops are trying to hold you down and all, especially as a black person there is reason to be afraid. On the other hand, she would not listen to what they were trying to tell her and kept screaming and kicking.

(5,067 posts)The teen was charged with disorderly conduct, two counts of second-degree assault, possession of marijuana and failure to obey a traffic device. She was taken to the Police Department and released to a parent.
Her father then took her to the hospital, where after 3 hours, she was treated for chemical burns to her face and eyes. And finally checked for a concussion.

The only treatment she got (from police) was slamming, abuse and Mace, Ficker said. He also said the police contacted the hospital and ordered them not to take any photos of the girls chemical burns.

(115,677 posts)Restrain them so they don't further harm themselves. Cuff wrrists behind back, again in case they have a seizure and start to flail around. Argue with the injured person to get their adrenaline and bp raised to ensure adequate tissue perfusion of blood. Then carry by feet and shoulders so you don't risk injuring their neck. Then shove into a vehicle and pepper spray to make sure their pain center can still react correctly.
Finally, pause at the police station to monitor for a few hours before handing off to trained medical personnel, to give the body time to really develop symptoms so the ER staff will have an easier diagnosis.
See? It's all perfectly sensible!
(For real, those are all things you should not do. Unless you don't care to help them)

(11 posts)I nearly threw up watching that poor girl suffer like that. This is exactly what Trump's idea of what America should be like. He would turn our already brutal and aggressive police force into the new Gestapo, jackboots and all.

He's clearly too GD stupid to be a police officer.
Not sure what was going on with rest of it, and I will say the girl seemed a little self absorbed and ridiculous, but the cops in this video are clearly not very well trained.
