And an extremely poor driver. Hope the driver and any passengers in the truck are okay. Huge lawsuit can be filed by them

kicking a car is stupid, but in and of itself not likely to be hugely dangerous except possibly to the motorcyclist himself if he were to lose control.

the driver of the sedan, on the other hand, took an action that was designed to put the motorcyclist in quite possibly mortal danger, then proceeded to lose control and put many more lives in jeopardy.

"idiot" and "extremely poor driver" is letting the sedan driver off far too easily.

actually the damage to the sedan and any bumps or scrapes the driver got are just a small down payment on that karma.

But totally uncalled for.. I've had people who were not paying attention (cell phone) almost run me off the road, stop short in front of me and one time run right up my rear end. That one almost killed me and I had to move quickly out of the way. People are just too poor to pay attention...
Once I had a guy in a big SUV just didn't give a shit and was going to take my space. He LOOKED at me and turned into me. I had a VERY loud pair of air horns on my bike and blew a loud report. He freaked out and swerved away and almost went into a ditch. Road rage took over and he was after me.. Lucky I had a very fast bike and made a hasty retreat.... advance really .
Got off at the next exit and saw him still weaving thru traffic looking for me.
As they say down here in the caribbean.. the biggest boat has the right of way...
He hits you, y'all gonna loose. It ain't worth it...
The vid does not show WHY he kicked the door. This dipshit on the Harley was lucky and the other people weren't...

But of course, we didn't see what was going on before hand. Either way, it looks to me like that driver is in a heap of trouble.

The motorcycle rider's action were obviously intentional. Not so with the sedan driver.

There's a video that show the two driving side by side just before he kicks it.
When he kicks it, it appears it does nothing more than dent the car. It looks to me like the driver was pissed and was stupid enough to make a hard turn into the motorcycle while going 65.

Here's a little longer video.

Just my opinion.

Logically it should not be, but what are the actual California rules. He's only one driver.

You're permitted in the carpool lane as a solo driver, if you are driving an electric /hybrid car; they give you a sticker that goes on the side of the car, to show it's permitted.

The motorcyclist acted like a child by kicking the sedan, but worse, he or she just drove off from the scene of an accident.

From witnesses in the report, it appears that the sedan had cut off the motorcycle before the video began. Then the cycle accelerated to be next to the sedan in order to kick it in retaliation. The cyclist is an idiot! His anger provoked a dangerous situation and endangered his own life!

Importantly, I believe you are correct, cab67, the cyclist may be liable for causing and leaving the scene of an accident.

AND YET, on the other hand, I'm not convinced that this story is entirely clear. What happened before the video began? Let's examine the sedan driver's cell phone; was the driver texting or phoning prior to the accident? Did that driver interfere with the cyclist's legitimate rights under the rules of the road?

It is perplexing to me why people get into arguments while driving. It's far too dangerous. Whenever I sense an aggressive driver, I pull over to the right lane and let them go ahead. I want to live.

The motorcyclist presumably didn't kick the sedan out of a long-standing hatred of the car type.

Life is too short for this sort of thing. I've had people cut me off, and I've accidentally cut people off myself, usually when they're in my blind spot and I'm undercaffeinated. Mistakes are mistakes - anything beyond a rude hand gesture is overkill.

They were both equally guilty of road rage but since the cyclist died the car driver was found guilty for killing him.
