Non-smokers rights in the workplace ???

I know this will be state specific.

Can an employer fire an employee who refuses to perform work in an out of office environment due to the presence of cigarette smoke?

I kind of need to know, I am going to have to refuse to go back to a clients house because of the smoke and the cat allergens. Its just not worth my health. I spent 2 days after the last visit feeling like I had the flu.

However, this is what you need to do to protect yourself. You need to ask your employer for what is known as a "reasonable accomodation" due to a health condition. Depending on your situation, this may grant you specific protections under the ADA which are enforceable by the EEOC. Your employer may ask for medical documentation to support your request.
