One can also obtain a conviction on a technicality.

Once, about twenty-five years ago, I served on a jury for a man accused of drug possession and trafficking. One of the charges was possession of a legend drug without a prescription. I lost track of how many times the defense attorney told the jury that the burden of proof was on the prosecution. But, during deliberations, I told my fellow jurors that the accused even being charged with possession of a legend drug was proof enough for conviction.

I told them that, if I were a defense attorney with a client who was charged with possession of a legend drug without a prescription, even though the burden of proof is on the prosecution, the first thing I would do would be to call a doctor and find out if my client had a prescription. If he did, that would get the charge thrown out.

The very fact that the charge was on the sheet is proof of guilt.

We voted to convict the defendant.

I have always been too radical to be on a jury. I think I've been called twice.
