(1,303 posts)routinely crawled up under the siding of the houses in her neighborhood and gained entry to the houses. It was illegal to kill them. She could not let her kids play in their own yard.

(1,303 posts)Regardless of why a snake may have entered a residence or work area, most people just want to know how to remove it. However, people confronted with a snake must understand that under existing wildlife regulations, it is illegal to kill any species of snake in Virginia unless it presents an imminent threat to ones personal health and safety.
Snakes are classified as nongame species and therefore are afforded full protection under existing nongame regulations, similar to all other species in this category. In the case of the canebrake rattlesnake, which is one of Virginias state-listed endangered species, neither the animal nor its habitat can be destroyed.
So unless it is actually threatening to bite you, you cannot legally kill it.

Also makes me wonder if we have such a rule here in Iowa?
My brother is deathly scared of snakes - literally has passed out on seeing them.

Copperheads account for more cases of venomous snake bite than any other North American species; however, their venom is the least toxic, so their bite is seldom fatal. Venomous snakes are distributed unevenly throughout the United States the vast majority of snake bites occur in warm weather states.

(16,383 posts)About an acre of land in back of our house and we had copperheads. Every now and then one would make its way up to our back drive. Once, when we were playing in the fall leaves, I felt something wrap around my ankle, a copperhead. I panicked and kicked if off. They are not terribly aggressive, although it sounds like the one in the restaurant was. Yikes, is right.
