Lawyers want the Florida Supreme Court to rule on home-rule question
Just when you thought the residency case of Tallahassee City Commissioner Scott Maddox was over, city attorneys want to prolong it just a little bit longer.
They want the Florida Supreme Court to address whether state courts can usurp the city's authority to determine the eligibility of its own elected officials.
That is a question involving the limits of state court jurisdiction, the separation of powers under the state Constitution, and the Citys home-rule powers, they wrote. It's also a case that will "have an impact on municipal governments throughout the state," they said.
The Supreme Court issued an order to show cause why the city's petition for a writ of prohibition shouldn't be declared moot since Erwin Jackson said he doesn't plan to appeal the Leon Circuit Court's ruling Tuesday that Maddox lives in the city.
