Report: Houston woman in fundraising case will not testify against Rep. Michael Grimm

STATEN ISLAND, N.Y. - The Houston woman accused of illegally donating more than $10,000 to GOP Rep. Michael Grimm's 2010 campaign will not testify against Grimm in exchange for a deal on the charges against her, according to a published report, setting the stage for a trial in Brooklyn federal court.

Attorney Stuart Kaplan said federal prosecutors were expected to seek a new indictment against Diana Durand after a court date to discuss plea negotiations was cancelled on Monday, according to the Houston Chronicle.

"Ms. Durand is committed to exercising her constitutional right to go to trial," Kaplan told the paper.

A trial date has not yet been set.
