Nuclear plant guard fired over drinking, paranoia can't have his job back, U.S. court says
An armed guard at a Pennsylvania nuclear power plant who was fired over alcohol abuse and mental health issues that blossomed into paranoia has failed to convince a federal appeals court panel he deserves to get his job back.
In fact, the judges on the U.S. Court of Appeals for the Third Circuit concluded Tuesday that PPL would have been violating federal safety regulations if it hadn't fired Daryle R. McNelis.
McNelis, a Bloomsburg resident who once guarded PPL's Susquehanna Steam Electric Station, claimed his 2012 firing was illegal under the Americans with Disabilities Act. He argued that the diagnoses that led to his termination were faulty and that he wasn't given a chance to contest them.
McNelis appealed after U.S. Middle District Judge Matthew W. Brann denied his first plea for reinstatement.
