Earliest date for primaries May 29, court says

“It appears based on all the things that are going on here that it is extremely unlikely there will be a primary in April or for that matter before May 29,” said Judge Jerry Smith.

Greg Abbott will probably find a way to move this primary to an even later date

Deal means state Sen. Wendy Davis' district will stay the same

Negotiators in San Antonio -- trying to find common ground on state legislative and congressional districts so a primary date in Texas that can stick may finally be set -- agreed to leave unchanged state Senate District 10, now represented by state Sen. Wendy Davis, D-Fort Worth.

This district has been the subject of lawsuits and is seen as a big win for Davis.

Last year, Fort Worth-based Senate District 10 was a key target for Republicans in the Legislature during redistricting. The Senate map the Legislature approved cut out heavily African-American areas in south and southeast Tarrant County and Hispanic areas in north Fort Worth. It also added Republican-leaning parts of Northeast Tarrant County, including North Richland Hills, Richland Hills, and Watauga. The new map was widely seen as more favorable to Republicans. Davis sued, accusing Republican leaders of violating the Voting Rights Act and disenfranchising minority voters in her district.

Redistricting Lawyers Reach Deal on Texas Senate Maps

The primaries won't be held until May 29, the judges said after a brief recess. Judge Jerry Smith said an April date appears to be impossible, and asked the lawyers for the political parties and the Secretary of State to pull together details for filing deadlines and such assuming May 29 will be the date. He also said that it's not a certainty; they still don't have all the maps they need to hold an election.

SAN ANTONIO — Redistricting foes reached agreement on a statewide map for Texas Senate elections this afternoon and continued working on state House and congressional maps.

The fight over the Senate map was all about Tarrant County's Senate District 10, where Democrat Wendy Davis is the incumbent. Under their agreement, they'll leave the district alone, leaving Davis with the same plan that put her in office. It's a marginally Republican district that voted for John McCain for president in 2008 and for Rick Perry for governor in 2010. But for Davis, who had been drawn into a more hostile district by her fellow legislators, the deal is a win.

The lawyers presented it as an "interim" plan, meaning they reserve the right to fight again when permanent maps are drawn. But if it's approved by the court, this will be the map used for the 2012 elections.

As their presidential candidate will probably be decided by then, so hopefully they'll be too pissed to even show up!

And to Wendy Davis We really need her presence to represent Tarrant County.

There are a number of current GOP officeholders who have tea party types running against them in their primaries. In Fort Bend County, there is a King Street Patriot idiot runing against Pete Olson. This lady has already won a straw poll of tea party members. Here is a link to her website http://www.barbaracarlsonforuscongress.com/ This lady is just as nuts as Allen West and Joe Walsh.

In a lowturnout race, a tea party type could defeat Pete Olson who has not really accomplished anything other than passing a resolution thanking O'Keefe and his girl friend for committing a fraud against ACORN.

Abbott's stupidity may well cause some of the current GOP officeholders to lose their primaries.

There is a possibility that the San Antonio three-judge panel (which handles Section 2 challenges of the Voting Rights Act) will wait to see what the Washington D.C. three-judge panel (who handles Section 5 challenges of the Voting Rights Act) rules, and that subsequently, the San Antonio panel incorporates the D.C. panel’s findings into new maps. The D.C. panel indicated that it would not rule prior to March. Consequently, if the San Antonio panel is waiting on the D.C. panel, a May 29th primary could only be accomplished if the D.C. panel rules at the very start of March and the rulings can be incorporated into alterations of the maps within a few days. Otherwise, only the June 26th primary date is an option.

That will teach them a hard lesson. Of course the bad news is that if any of these tea party types actually win in their primaries we end up with that many more crazies in the Lege.

The Democratic Party is looking at rules for the Senate District/County conventions tonight and should approve these rules on Thursday.

The San Antonio Court evidently asked for the parties to tell the Court by Wednesday what is needed to hold the primaries on May 29. [link:http://txredistricting.org/post/18402871970/court-asks-political-parties-to-submit-update-by|

Sources advise that the San Antonio court has asked the Democratic and Republican parties to submit an advisory by this Wednesday, February 29, at 2 p.m., on changes to provisions of the Texas Election Code needed in order to have a May 29 primary
This would put the run off sometime in August or so

Under the parties’ proposal:

The filing period would reopen Friday, March 2, and close a week later on Friday, March 9 at 6 p.m.

Ballot order draws would need to occur in each county on or before March 12, 2012.

Precinct boundaries would need to be redrawn by or before March 20, 2012.

Military and overseas mail ballots would need to be mailed by April 14, 2012.

New voter registration certificates would need to be issued by April 25, 2012.

The primary runoff would be July 31, 2012.


This timetable is based on either the DOJ or the DC court pre-clearing the new interim maps. I expect there to be a fight on this

For residency, the court ordered that candidates for state house and state senate need to be residents of the district they are running in by April 9.

Federal Judges Order May 29 Primary Elections

The Texas political primaries will be on May 29, a panel of federal judges ordered this afternoon, and candidates can file for those elections starting tomorrow and ending on Friday, March 9.

Candidates who already filed can drop out, stand pat or switch to other races. Candidates who didn't sign up during a filing period last year can sign up now. The parties have to deliver a completed list of their candidates to the Texas Secretary of State by Monday, March 12.

The three federal judges unveiled maps for legislative and congressional elections earlier this week. Those maps won't necessarily last for the decade, but barring a successful (and fast) appeal to the U.S. Supreme Court, they're the maps that will be used for the 2012 elections.


It's a done deal.
