Defendant-Intervenor Texas Latino Redistricting Task Force (TLRTF) states that CD 25 is an Anglo majority district in which Anglo voters dominate the Democratic primary . Id. at 3. It is ORDERED that TLRTF shall submit, by 5:00 PM on March 13, 2012, a fuller explication of its reasoning for and the evidence behind its conclusion that Anglo voters dominate the Democratic primary in CD 25. Any other party wishing to submit views on this subject shall do so within the prescribed time-period

(145,462 posts)I was hoping for a decision from the DC court soon. This request for briefing means that the Court is looking hard at CD25 and that there will be no decision this week.
I prefer that the court takes its time and get this right. I really do not care if we have primaries on May 29 and would not mind seeing the primaries moved to June 26

f the D.C. court issues an opinion saying that District 25 deserves protection, it could throw Texas' election schedule into turmoil again. That's because the San Antonio court adopted the Legislature's boundaries for District 25 in drawing the congressional map to be used for this year's elections.
Assuming the D.C. court will allow enough time to produce new maps by March 31, the San Antonio court could redraw new boundaries for District 25 and the surrounding districts, said Michael Li, a redistricting expert and author of a Texas redistricting blog. But because of tight timetables, any changes would force the court to push back the primary until June 29, almost four months after the original date of March 6.
But if the D.C. court does not allow for new maps to be drawn by March 31, then the primary would have to be pushed back to July with a runoff in September a move that would be problematic because of general election deadlines, Li said.

In a filing late yesterday, the Travis County plaintiffs told the San Antonio court that the D.C. courts request for briefing on CD-25 might have potential bearing on San Antonio courts final application of the not insubstantial test.
Although they did not say so directly, the filing hinted that the D.C. courts request for additional briefing on the Texas Latino Redistricting Task Forces claim that Anglos dominate the Democratic primary in CD-25 suggested that the court did not find the claim supported by evidence - or at least that the DC court was wrestling with the issue.
I have a feeling that the Travis County plaintiffs will be responding to the request of DC court and will attempt to convince the DC Court to protect CD 25 and reject splitting Travis County between five different congressional districts. I am still hoping that the DC Court will delay matters and not pre-clear the interim maps. I am hoping that the May 29 primary is push back to June 26.
BTW, according to Romney's math, he needs a good percentage of the Texas delegates to go over 50% which is really sad for Romney

You can read the briefs by going to this link http://txredistricting.org/post/19255485203/briefs-on-cd-25-and-the-anglo-domination-issue The brief from the State of Texas and the Latino task force are weak and argue that CD25 was not protected. The other briefs have some good back up as to why Doggett's seat should be protected.
Hopefully, the DC court will take some action on this issue.

With no preclearance decision having yet been rendered, the Texas Latino Redistricting Task Force asked the D.C. court today for permission to file one last brief on CD-25.
The filings said that the Travis County intervenors had mischaracterized - or misunderstood - the data on CD 25 and had introduced no evidence showing that CD 25 is anything other than an Anglo majority district in which Anglo voter preferences drive the outcome of both the [Democratic] Primary and the General Election.
In particular, the Task Force criticized the Travis County intervenors for what it said was their focus almost exclusively on voting patterns in Travis County. They said that approach was problematic ecause most of Travis Countys population, and voters, are located outside benchmark CD 25 [and therefore] Travis County election returns are primarily based on the votes cast by voters living outside [the district].
They also criticized the Travis County intervenors reliance on 2004 Democratic primary results (in which Lloyd Doggett defeated a Latina opponent), noting that the 2004 primary took place in a very differently configured version of CD-25 that ran to the U.S./Mexico border before the district was redrawn by courts in 2006.
I have been hoping that the DC circuit would issue an opinion this week. This latest filing may slow down the process.
After reading the briefs, I still think that CD25 should have been protected. The fact that Cuellar's group filed yet another brief shows that they are worried about this issue. Cuellar is a traitor to the party and to the rights of other Hispanics.
