However, if two consenting teens are within three years of age and of the opposite sex, state law provides an out for the older partyan affirmative defense to the charge of indecency with a child, otherwise a second-degree felony.
The same affirmative defense is not offered to teens of the same sex, meaning LGBT youth can face prison time for consensual sexual contact, including heavy petting.
Its unclear whether an LGBT teen has ever been charged under the statute, but House Bill 71, by Rep. Mary Gonzalez (D-El Paso), aims to prevent it from happening in the future. The bill would remove five wordsand of the opposite sexfrom the affirmative defense provision.

(112,198 posts)I believe that the representative sponsoring the bill is one of the two lesbian house members so it is unlikely to get out of committee.

(14,337 posts)One was 15 and the other 17. It wasn't until the older girl turned 18 that the younger girl's parents decided to prosecute. This type of 3 year age criteria, whether straight or gay, would go a very long way in solving this problem. Many states have this on the books, sexual orientation neutral.
