Texas Supreme Court upholds Austin judge’s grant of divorce to two lesbians

AUSTIN — The Texas Supreme Court has declined to overturn an Austin judge’s 2009 granting of a divorce to two lesbians who were married five years earlier in Massachusetts.

In a 5-3 ruling, the court on Friday said then-Attorney General Greg Abbott did not have standing to intervene in the couple’s divorce.

Abbott had argued that a Texas court can’t dissolve a marriage that the state doesn’t recognize. A voter-approved state constitutional amendment and the Texas Family Code prohibit same-sex marriages or civil unions.

Writing for the majority, though, Justice Jeffrey Brown said the attorney general did not move to intervene until the divorce was granted. That was too late, Brown wrote.

According to federal law, each state must recognize a contract legally and legitimately made in any other state. So, when it comes to marriage, a state that prohibits marriage for very young people, or marriage between cousins, has to honor a marriage between 13 year old cousins, if it was done in a state that permits such marriages. But not gay marriage. Oh my God, no! It's just fine to recognize a shotgun marriage between a couple kids from Possum Holler, but not a marriage between two adult men or women. I guess you could call that hypocrisy, but that seems like an understatement.
