Lawsuit accuses Buda police officer of tackling 73-year-old man

A Buda couple has filed a federal civil lawsuit against the city of Buda, Wal-Mart and a Buda police officer that accuses the officer of false imprisonment and excessive force stemming from a violent encounter two years ago.

According to a complaint filed on Monday, Juan Martinez was thrown to the ground at a Wal-Mart in the 600 block of Old San Antonio Road after his wife was detained under suspicion of shoplifting on Oct. 3, 2014.

The document said Martinez, then 73, and his wife, Guadalupe, were shopping together at the store just before the incident.

“(Martinez) and his wife were going through the store on scooters, due to their inability to ambulate easily,” the complaint said.
