U.S. Supreme Court Justice Samuel Alito on Monday temporarily halted enforcement of a lower-court ruling that required two Texas congressional districts to be redrawn because they discriminated against minority voters.
Responding to an appeal by Texas Attorney General Ken Paxton, Alitos one-page order provided no reasons for the halt, saying only that the Aug. 15 ruling by the San Antonio-based three-judge court was blocked pending receipt of a response from lawyers for the civil rights groups, Democrats and minority voters who challenged the Texas congressional maps.
Alito said their response is due by Sept. 5 the same day the three-judge court had scheduled a hearing in San Antonio to begin work on redrawing the districts that include portions of Travis and Bastrop counties.
Were encouraged by Justice Alitos decision today, Paxton spokesman Marc Rylander said. We remain hopeful that the entire court will allow Texas to continue to use the maps that were in place the last three election cycles.

(9,956 posts)...of what to fight. It's not about a coal miner in Pennsylvania who didn't vote for Hillary. Texas should be "purple" at least, and is moving toward Democratic majority. There are a lot of great Democrats there!

(1,399 posts)This one-judge stay only lasts until the Plaintiffs below file their response. Stays like this are almost always granted, especially when the party seeking the stay is a State. It means nothing more than that Samuel Alito, the most ideologically-driven justice on the Court, thinks the application is not frivolous.
Now, if the Court were to extend the stay pending certiorari, we could pretty much kiss this win good-bye. That takes at least 5 justices to agree that the State of Texas' chances of ultimately prevailing are substantial and/or that Texas will be irreparably damaged if it is forced to redraw these districts.
But Alito himself? I wouldn't give what he says the weight of a gnat even if he was shouting "Look out for the bus!"
