Tracci's motion: Asks judge to vacate Kessler dismissal

The little bit at the end intrigues me. Jay is apparently going after Kessler in a civil proceeding.

Tracci’s motion: Asks judge to vacate Kessler dismissal

Two weeks ago a judge dismissed a perjury charge against whites-righter Jason Kessler because the prosecution didn’t establish that the alleged crime took place in Albemarle. Legal pundits decried the misstep as a rookie move.

Commonwealth’s Attorney Robert Tracci filed a motion to vacate that decision April 3, claiming that Judge Cheryl Higgins erred twice in her decision to dismiss, and now local legal pundits are again abuzz about whether the unusual move has a chance to bring Kessler back to trial, despite the specter of double jeopardy.

The perjury charge stems from Kessler swearing to a magistrate that Jay Taylor assaulted him on the Downtown Mall in January 2017 as Kessler collected signatures for a petition to remove then vice-mayor Wes Bellamy from office. Taylor was charged, but the Charlottesville prosecutor said she dismissed the complaint because video did not support Kessler’s allegation that he was assaulted.

And in other Kessler litigation news, Taylor filed a civil complaint against Kessler April 3, according to court records.

Great photo of Jay at the top. I've always enjoyed my interactions with him. This story is good background about Kessler who later brought the white supremacists to Charlottesville to rally in August.

Jason Kessler, the right-wing blogger who unsuccessfully petitioned to remove Vice-Mayor Wes Bellamy from office, pleaded guilty today to punching a man while gathering petition signatures, but challenged the victim’s statements outside the Charlottesville General District Court.

In the same court March 3, the prosecution asked the judge to dismiss with prejudice an assault complaint Kessler filed against Jay Taylor, the man he socked, because video footage from a nearby surveillance camera did not support Kessler’s account.

At today’s hearing, Kessler entered a guilty plea and will be sentenced April 27. Outside the courthouse, he initially responded to a request for comment by giving this reporter the finger, but then came back twice to make statements as the media interviewed Taylor.

The two were acquainted from working on an indie film project a few years ago, says Taylor, and when he ran into Kessler on the Downtown Mall January 22, “I took the opportunity to engage him.” Taylor says he read the petition to remove Bellamy from office, and took issue with the aggressive way Kessler was going after Bellamy.
