Eyman's car tab initiative on hold while Supreme Court decides

Initiative 976, the $30 car tabs measure, will not go into effect until the Washington State Supreme Court hears arguments and rules on legal challenges brought by plaintiffs ranging from big King County and populous Seattle, to rural Garfield County.

A King County judge's injunction, barring implementation of the Tim Eyman-sponsored initiative, will remain in effect while the Supreme Court rules whether it is constitutional. The high court decided unanimously Wednesday that it will "retain this case for hearing and decision" rather than kicking it back to a lower court.

The I-976 case will be heard on an accelerated basis, with initial briefs due May 15 and oral arguments to be heard during the court's spring term.

The courts have not always been kind to Eyman, nor Eyman to them. The Supreme Court, by a 6-3 ruling, threw out an Eyman initiative that would have required two-thirds "supermajority" votes in both houses of the Legislature to pass tax bills or close corporate loopholes.
