It was activated AND shut down without any changes to the law. Again, it depends on the interpretation, and how vigorously, say, the justice department is going to get into trying to find juries, etc. that will go along with these interpretations, again, of "obscenity" and "community standards".

Part of the issue, again, is that "obscenity" (like porn, as per P. Stewart) is in the eye of the beholder, and "community standards" are a shifting sand dune.

What the GOP platform is saying is that if elected, they will (as Bush did) make this a priority at the DOJ. Frankly, I think my tax dollars have better things to do than go after consenting adults for fucking on film.
