Homosexual man from Nablus, living in Tel Aviv, pleads for asylum on the grounds of well-founded fear of persecution
A gay Palestinian man appealed to the High Court of Justice on Thursday to overturn the Interior Ministrys decision to refuse him residency status, saying he risks death if he returns to the West Bank.
The Muslim resident of Nablus claimed that deportation to the Palestinian territories would result in his detention and torture by the Palestinian security forces and persecution by his family because of his sexual orientation.
His petition testified that Palestinian police had arrested, tortured and severely beaten him because he is openly gay. Most members of his family have disowned him, and those who havent have warned him by phone to never come home, he stated.

(45,850 posts)but in this case would you expect Israeli courts to just take his word for it, and even if they did I just read something about Israels asylum laws not applying to Palestinians due to the conflict or some such, however that being said I would think the fact that he has resided in Israel for 10 years should be taken into account and weigh heavily in his and his partners favor

...because he supports the occupation and settlements.
Any criticism of the PA is demonization and a cheap attempt to justify the occupation and settlements.
He's probably bigoted too.

(53,956 posts)The asylum laws don't apply to Palestinians if they are considered refugees from 1948 or 1967 or are receiving benefits from the UNRWA for Palestine Refugees in the Near East. Given he has resided in Israel for a number of years, he should be granted asylum, but his safety is a real concern and, hopefully, he will be allowed to stay!
