Eviction begins of settlers who broke into Hebron houses

Less than 24 hours after settlers entered Palestinian homes they claimed they had secretly purchased, security forces are removing them in move slammed by right-wing politicians.

Security forces on Friday morning began evicting dozens of Israeli settlers who broke into Palestinian homes less than 24 hours earlier near the Cave of the Patriarchs in Hebron, claiming that they purchased the properties in secret several days earlier.

Politicians on the right quickly condemned the move. "I call on the defense minister to immediately halt the evacuation of settlers from the houses in Hebron that were purchased in accordance with the law," said Immigration and Absorption Minister Ze'ev Elkin (Likud). "This is the time to fight terror and support strengthening the settlement enterprise, not to fight the settlers. Those who speak in the name of law and order are welcome to first of all deal with Palestinian Authority employees and radical leftist activists who execute Palestinians who dared to sell land or homes to Jews."

MK Bezalel Smotrich (Bayit Yehudi) wrote on Twitter that he had told Prime Minister Benjamin Netanyahu he would not vote with the ruling coalition until the settlers are allowed to return to the houses. Smotrich made a similar threat in the past, but ultimately did vote with the coalition. MKs Oren Hazan (Likud) and Ayoob Kara (Likud) declared that they would also refrain from being present at votes.

Defense Minister Moshe Ya'alon (Likud) responded to the criticism in a press statement, saying that "Israel has rule of law, and I have no intention of compromising when the law is violated. In the case of the houses in Hebron, the law was flagrantly violated. In order to enter the home, there are several legal actions that must be taken, none of which were taken. Thus, the intruders were evicted." He called on ministers, MKs, and elected officials to discourage people from taking the law into their own hands.

Rightist MKs threaten coalition over Hebron settler evacuation

Three right-wing Knesset members on Friday threatened to boycott coalition votes at the plenum after the Defense Ministry ordered the evacuation of Jewish settlers from two Hebron homes they had occupied under contested circumstances.

MKs Oren Hazan and Ayoub Kara of Likud, as well as MK Bezalel Smotrich of Jewish Home, said they would not attend Knesset votes until the settlers were allowed back into the buildings.

The ultimatum by the three MKs could pose a serious threat to Prime Minister Benjamin Netanyahu’s tenuous coalition, which holds only a 61-59 seat majority in the parliament.

Border Police forces evacuated several dozen Jewish settlers from the two houses in Hebron on Friday morning, a day after the settlers entered the buildings, claiming they had bought them from Palestinians. Security officials said the decision to clear them was made by the Defense Ministry.

The Jewish Home party, in an official statement, decried Ya’alon’s decision to “throw Jews out of their homes…at the height of a wave of terror.” The party called the move “irresponsible, bullheaded and inflammatory with no clear reason.” It advised Defense Minister Moshe Ya’alon to save such decisive action “for fighting Arab terror and clearly illegal construction in the terrorists’ communities.”

Meanwhile Jewish Home MK Shuli Moalem-Refaeli warned that “if Netanyahu cares about maintaining the coalition he had better intervene and restrain (Ya’alon).”

She claimed that “time after time homes are purchased legally within a web of complications, but once again the defende minister orders them evicted or demolished without a fair legal process being conducted.” She warned that if the policy, as well as the decision on the Hebron homes, were not changed — the party would discuss its next steps when it convenes on Monday.

Immigration and Absorption Minister Ze’ev Elkin of Likud also criticized the evacuation, saying that “this is a time to fight terror and support and strengthen the settlements, not fight the settlers.” He urged Defense Minister Moshe Ya’alon to allow the settlers to reenter the buildings.

Culture Minister Miri Regev (Likud) said that, if the homes were indeed purchased legally, the settlers should be allowed to return. “Settlement is an important Zionist act and we should persist in it,” she said.

Meanwhile, Knesset Speaker Yuli Edelstein of Likud urged authorities “to quickly ascertain the legality of the purchase and not to inflame the situation by evacuating settlers.”

He said that “in times when our enemies try to harm not just our bodies but our rights to the land,” it would have been preferable “to wait with the evacuation and review the legal options to bolster the settlers, while maintaining the rule of law.”

Ya’alon brushed off the criticism, saying the inhabitants had acted in “brazen” breach of the law, and urging lawmakers to calm their fiery rhetoric on the matter.

“The State of Israel is a nation of laws, and I have no intention of compromising when the law is broken,” he said in a statement.


“I call on the ministers, Knesset members and elected to officials to act responsibly, to restrain their remarks and to support the rule of law, and not to encourage (individuals) to take the law into their own hands and break it,” Ya’alon said, adding that “the conduct and statements of several politicians on this matter borders on wild abandon and damages our national fortitude.”

Ya’alon received support from the left in the form of a statement from Peace Now, which welcomed the evacuation.

“The government, not right-wing groups, must decide whether to settle and when, after an extensive and thorough examination into the genuineness of the deal,” it said. “Even if the settlers paid for the buildings, the entire Israeli public will pay the military and diplomatic costs of expanding the settlements in the heart of Hebron.”


The military has now forbidden entry into the buildings, and guards have been posted outside to prevent anyone from going in.

The settlers entered the homes near the Tomb of the Patriarchs on Thursday, using crowbars to break in, and raising the Israeli flag on the roof. They claimed the homes were secretly bought from the Palestinian owners.

Palestinians said the buildings were taken over illegally and they clashed with the settlers. The riots were broken up by security forces.

The only shared city in the West Bank, Hebron has for decades seen almost daily friction between its community of several hundred Jewish settlers and its much larger Palestinian population.

The Tomb of the Patriarchs, shared by Jews and Muslims, who both revere it as the final resting place of the Biblical Abraham and his kin, has been a particular source of tension in the city.

The phrase “settler takeover” is used fairly often by the international media to discuss a common occurrence in the West Bank and East Jerusalem. But rarely do the cameras actually capture just how this kind of thing is done. That’s why the sight of dozens of Israeli settlers with crowbars descending on two homes in the old city of Hebron is as surprising as it is disturbing.

The settlers, who took over the buildings on Thursday, claimed to have purchased the properties, located near the Cave of the Patriarchs. Israeli authorities were not previously informed of the takeover. According to Israeli political analyst Tal Schneider, the decision to take over the two homes was orchestrated by high-ranking members within the ruling Likud party, none of whom actually live in West Bank settlements.

Israeli security forces removed the settlers on Friday morning, with Defense Minister Moshe Ya’alon calling them “intruders” who “trampled the law” for not taking the necessary legal measures required to move into the houses. None of the settlers were arrested, however.

The last major settler takeover in Hebron occurred in April 2014, when three Israeli families moved into a contested home, following a years-long legal battle that culminating with an authorization from Israeli Defense Minister Moshe Ya’alon.

Palestinians claimed the property was purchased using forged documents, but Israel’s Supreme Court rejected that claim. Settlers often buy Palestinian land through front companies, the most famous of which is named Al Wattan (homeland in Arabic). Read more about fraudulent settler land purchase tactics here.

Earlier this month settlers used a front company meant to appear like a Swedish church group in order to purchase property for a new settlement in between Bethlehem and Jerusalem. Defense Minister Ya’alon eventually approved that purchase, to the chagrin of the United States.

Settlers in Jerusalem often use similar tactics to take over Palestinian property, even when the buildings themselves aren’t abandoned, such as the case of the Sub Laban family, whom settlers nearly expelled from their Old City home in March of last year.

In late 2014, Israeli settlers took over three empty apartment buildings in the heart of the Palestinian neighborhood of Silwan in East Jerusalem. They moved in under the auspices of Ateret Cohanim and Elad, respectively, two settler organizations based in the Muslim Quarter of the Old City that seek to create a Jewish demographic majority in East Jerusalem.

The buildings were purchased by foreign companies at the behest of the Committee for the Renewal of the Yemenite Village, which claims to want to re-establish the Yemenite community that lived in the area before the establishment of the State of Israel.

if these are legitimately purchased, that just seems like taking possession of property in a hostile neighborhood. i mean, if it's legitimately purchased, the purchasers have a right to take possession, right? if they are not legitimately purchased then no. it appears the Israeli government - which is obviously concerned with rule of law and not with conquest - was not convinced that it was legal to take possession of the properties in question at this time.

Excluding Jerusalem’s Old City, Hebron is the most incendiary of all the cities Israel conquered in June 1967. In Hebron, the settlers launched a plan to gradually take over places the government had intended to exchange in peace talks. The tension between Muslims and Jews – in Hebron in general, and around the Tomb of the Patriarchs in particular – led to killing on both sides. Dividing Hebron into two sections in the Oslo Accords didn’t lessen the conflict. Since the start of the current wave of terror last October, terrorism’s center of gravity has shifted from Jerusalem to Hebron, and the security forces are required to make considerable, persistent efforts to keep a lid on it.

However, at least one group, backed by political patrons – or even soldiers – isn’t interested in quiet in Hebron. The settlers who lead invasions into Palestinians’ homes and seize their lands will do anything to provoke the Palestinians and Israeli authorities, and foment unrest.
The settlers’ occupation of two empty buildings near the Tomb of the Patriarchs last Thursday wasn’t merely exercising real estate rights, as the settlers claimed. It was poking a finger in the eye of the Palestinians, the Israel Defense Forces – which is the sovereign in the occupied territories – and the government. The invaders knew full well that the security forces would be sent to evacuate them. They needed images of their evacuation to glorify themselves in their internal political struggle.


Ministers from the Habayit Hayehudi and Likud parties enlisted to support the invaders, contrary to the government’s policy – which was represented almost single-handedly by Defense Minister Moshe Ya’alon. Prime Minister Benjamin Netanyahu, who may have backed Ya’alon by saying “We’re all committed to respect the law,” was alarmed by the pressure and promised the settlers that only paperwork stood between them and the properties they had occupied. The prime minister’s aides tried to placate the settlers and praised their “courageous resistance to terrorism.” This was a cowardly statement that ignores reality and stems mainly from Netanyahu’s fear of popular political rivals Naftali Bennett and Avigdor Lieberman, who are undermining him.

Jewish settlement in Hebron, including home invasions, has constituted a decisive contribution to terrorism. Even if the prime minister has forgotten Baruch Goldstein and the 29 Palestinians he murdered at the Tomb of the Patriarchs in 1994, Netanyahu, more than anyone else, keeps accusing the Palestinian Authority of incitement against Israel and responsibility for igniting the area.

In fear of the political dangers regarding himself, Netanyahu is oblivious to the dangers awaiting Israel. The signs of the international front being formed against Israel are mounting: the U.S. administration’s public objection to Israel’s double standards in enforcing the law in the territories; the Palestinian Authority’s move to bring about a UN Security Council resolution classifying settlements as illegal; and Brazil’s refusal to accept the settlers’ head, Dani Dayan, as ambassador – these are only some of the signs.

Instead of responding to these developments, Netanyahu is busy groveling to the settlers. The price for this will be paid by all Israelis.

Defense Minister Moshe Ya’alon ordered their removal, called them “intruders” on Friday and said they had acted in “brazen” breach of the law.

But according to “settler sources” cited by Israel Radio Sunday morning, a compromise agreement is in the works that would see them occupy one of the buildings while the legality of their claimed purchase of both is examined by Defense Ministry officials.

The officials are demanding that the homes open toward the Jewish neighborhood of Avraham Avinu, and not have any openings toward Palestinian areas of the city, in order to prevent possible shooting or firebombing attacks, the report said.

Discussions on entering the second home will take place later, according to the report.

the Palestinians could not be evicted at all, IOW it's all legal technicalities, if history is any indicator here the best the Palestinian family(s) can hope for here is a lengthy court battle, over whether or not the settlers alleged purchase of property is legitimate during which they may or may not be allowed to live in their homes

Prime Minister Benjamin Netanyahu said at Sunday's cabinet meeting that Israel will allow the settlers evicted from two houses in Hebron to return once the proper paperwork is in order.
"The government supports the settlements, especially in days like these, when they are under terror attacks," adding that "at the same time, we are a lawful country and must respect the rule of the law," Netanyahu said.

"The moment that the purchase process is authorized, we will allow the population of the two houses in Hebron," Netanyahu continued, confirming comments made Friday by officials at the Prime Minister's Office that the Israeli settlers evicted from two houses in Hebron earlier in the day would be allowed to return once they receive the proper permits. 

"We will begin the examination today and we will do it quickly. If it doesn’t come to an end within a week, I will make sure that a status report will be submitted to the cabinet," said Netanyahu.

Netanyahu also thanked U.S. President Barack Obama "for deciding to attend an event marking International Holocaust Remembrance Day at the Israeli Embassy. This sort of thing hasn’t happened in many years, and it is more proof that the relations between Israel and the U.S., despite the disagreements, are solid and strong."

The Israeli embassy stated that this would be the first time this ceremony, held in cooperation with Yad Vashem, will be held in the U.S. The families of the four people to be posthumously honored will attend, alongside top administration officials, congressmen and Jewish community representatives. 

"We've heard over the past years talk of the collapse of the relations. What happened are talks of collapse, but it seems that the relations are getting stronger – for example the memorandum of understanding that we will likely reach in the upcoming months regarding defense aid for the next 10 years," Netanyahu said.

When I heard the prime minister tell his ministers about settlers and Hebron, the book "If I Ran The Circus" popped into my head. Now I know why.

When I was small, one of my favorite books was "If I Ran the Circus" by Dr. Seuss. It was the story of a preposterous idea with an ironclad internal logic, a fantasy of contortion and construction which grows and grows until it takes over everything – with absolutely no heed paid to any one of the possible disastrous consequences.

It's a book that explains what might happen if the West Bank ran the rest of us. That is, if the settlement movement, out there behind Mr. Netanyahu's store, ran the state of Israel.

For some reason, it was that book that popped into my head as I was listening to the prime minister address the Sunday cabinet meeting. "The government supports settlements at all times, especially these days" he began, with an oddly Seussian lilt to the cadence of his prepared remarks.

The prime minister had been pressed to explain why two days before, his defense minister – decrying "intruders" who had acted in "brazen" disregard of the law – had forcibly evicted dozens of settlers who broke into and took over two buildings in the West Bank flashpoint of Hebron.

The eviction sparked a mutiny in Benjamin Netanyahu's ruling right-wing bloc, with two of the scariest clowns in the settler-circus coalition, MKs Bezalel Smotrich (Habayit Hayehudi) and Oren Hazan (Likud) threatening to absent themselves from a vote on a vote which Netanyahu does not want but politically sorely needs – the much-vilified, much-hyped, right-elite-driven NGO Bill.

Not to worry, the prime minister assured the settler-rich, settler-subservient cabinet in a display of high-flying, daredevil, split-second bureaucracy unlike anything Israelis experience under any other tent: "The moment that the processes of purchasing [the structures] are approved, we will allow the two homes in Hebron to be moved into, as has happened in similar cases in the past."

Then the prime minister, flying without a legislative safety net, took the trapeze even higher, adding a crowd-gasping flip. "The process of checking [the legality of the alleged purchases of the houses] begins today. We will do this as fast as possible." 

In an apparent finale, he let go of the trapeze and appeared to wing it, adding another breathtaking clerical turn: "In any event, if it is not completed within a week, I will see to it that a report on its progress is provided the cabinet."

It was his landing, though, that confirmed the true status of the cabinet as the Settlers' Big Top. Throwing Defense Minister Moshe Ya'alon under the clown car, Netanyahu signaled that he was moving to strip Ya'alon of the authority to evacuate settlers from West Bank homes. The power to do so would be transferred to an unspecified committee – at the request of settler circus ringmaster Naftali Bennett. 

No worries. Naftali Bennett merely took another leaf from the example of young Morris McGurk. Just a tree to chop down in a vacant lot, junk to haul out, a few tents to put up. And there you are.


"The Circus McGurkus! Collossal! Stupendous! Astounding! Fantastic! Terrific! Stupendous! I'll bring in my acrobats, jugglers and clowns, from a thousand and thirty-three faraway towns. To the place that you'll see 'em, ladies and gents, right behind Sneelock's Store, in the Great McGurk tents! 

"And I don't suppose old Mr. Sneelock will mind, when he suddenly has a big circus behind."

As long as we let Mr. Sneelock, or Mr. Netanyahu, have a fancy suit and stand out front as the titular master of ceremonies, he'll be fine with it. 

"After all, Mr. Sneelock is one of my friends. He might even help out doing small odds and ends."

In fact, whatever we settlers ask him to do, he'll be fine with it. Even if, some day, we need him to take a fall for us. He is, after all, expendable. As opposed to us.

His nerves are like iron, his muscles like steel. And he plunges! Down! Down! With his hair still combed neat. Four thousand six hundred and ninety two feet!

Then he'll land in a fish bowl. He'll manage just fine. Don't ask how he'll manage.
That's his job, not mine.


For the rest of us, that could be the only good news in any of this. That, and the clown corps, which may be the only group in this entire huge circus of ours which is capable, one of these days, and inadvertently, of bringing the big top of occupation down on their own heads.
