Israeli group threaten legal action against Australian charity

An Israeli-based group is threatening legal action against an Australian charity unless it immediately stops funding a Palestinian not-for-profit organisation that is alleged to be “an active arm” of a terror group proscribed under Australian law.

World Vision Australia, which distributes funds in Gaza for AusAID, the government’s foreign aid agency, denies the charges. An AusAID spokesperson said this week that an investigation it conducted in May concluded there was “no evidence to support Shurat HaDin’s allegations”.

But Shurat HaDin this week stood by its allegations, releasing a dossier of “conclusive evidence” to World Vision with an ultimatum to the Christian charity: cease funding by October 15 or face legal action in the Federal Court of Australia for breaching the Charter of the United Nations Act.

On 31 May, 2012, the Australian Foreign Minister Bob Carr issued a statement that "An AusAID examination has concluded there is no evidence to support claims by the Israel Law Center (Shurat HaDin) that funding through World Vision Australia to a Palestinian NGO, the Union of Agricultural Work Committees (UAWC) was in violation of section 21 of the Charter of the United Nations Act, 1945.". He also added, "I understand the material provided by the Israel Law Center has been carefully examined by AusAID in consultation with other agencies including the Australian Federal Police and the Australian Security Intelligence Organisation". On 6 October 2012, World Vision issued a detailed, 5-page letter to Shurat ha-Din, in which it was stated that the claims were "unsubstantiated, and in some circumstances, defamatory". [18]

The Executive Council of Australian Jewry has intervened in the dispute between Israel’s Shirt HaDin and World Vision Australia over the former’s claim that World Vision was funding a terrorist organisation.

The Executive Director of the ECAJ, Mr Peter Wertheim AM, convened today’s meeting between Akiva Hamilton of Shurat HaDin, World Vision Australia’s General Counsel, Ms Seak-King Huang, and Professor Tim McCormack, advisor to World Vision Australia.

The purpose of the meeting was to discuss the issues that have been canvassed in correspondence between Shurat HaDin and World Vision Australia regarding World Vision Australia’s AusAID-funded project with the Union of Agricultural Work Committees (UAWC) in Gaza.

Several ideas were put forward with a view to achieving a resolution of the issues.
