The Ministerial Committee for Legislation is scheduled to vote today on a draft law that would specify that Israel is the nation-state of the Jewish people.
The current iteration of the bill Basic Law: Israel as the Nation-State of the Jewish People is sponsored by coalition whip MK Zeev Elkin (Likud), and is considered the most extreme of a series of similar legislative proposals that have been raised this year. In addition to giving Israels nation-state status for the Jewish people the force of constitutional law, it specifies that Jewish law is to be a source and inspiration for new legislation and judicial rulings. And a previously scrapped clause, under which the Arabic language would no longer be an official language of the state, instead enjoying special status, has been restored.
It is thought that Elkin is now pushing the more extreme version of the bill, which would subordinate the states democratic nature to its Jewish character, in order to protest the lack of progress by a panel established by Prime Minister Benjamin Netanyahu and Justice Minister Tipi Livni for the purpose of hammering out a compromise version of the bill. Elkin reportedly fears the committee is simply trying to buy time and does not intend to really advance the matter. The committee has met just twice, and has not convened since the early summer.
Two weeks ago Netanyahu and Livni met with Prof. Ruth Gavison, an expert in Israeli constitutional law, who is leading the process of translating the committees recommendation into a bill. They are scheduled to meet again within a few weeks to discuss the issue.
Elkin knows that if he can push the bill through the ministerial committee, meaning it has the backing of the government coalition, and through its first legislative reading during the current Knesset session, the legislative process could be continued in the next Knesset.

The bill proposing a basic law on Israel as the nation state of the Jewish people will be presented to the Ministerial Committee for Legislation on Sunday in its original form. This version, by MK Zeev Elkin (Likud) which differs from the laundered version presented by MKs Yariv Levin (Likud) and Ayelet Shaked (Habayit Hayehudi), which was discussed by the committee and passed on to a special committee headed by Justice Minister Tzipi Livni lets the cat out of the bag: The Jewish character of Israel supersedes its democratic character. The Jewishness of the state is manifest in discrimination against Arabs, and its democracy is none other than a regime that lets the majority do anything it wants and exploits the minority.
The current version of the bill states specifically that it is intended to outrank any ordinary legislation or basic law that preceded it, and that all legislation will be interpreted through it. Thus, the bill undermines the Basic Law on Human Dignity and Freedom (1992), which ensures the right to human dignity, including the right not to be discriminated against based on affiliation to a certain group.
The bill also obviates the official status of the Arabic language, encourages preference for Jewish communities as opposed to non-Jewish ones, and declares that the state reserves the possibility to establish communities on the basis of national or religious affiliation.
According to the bill, while Jews have a collective right to heritage and culture backed by the state, Arab citizens may foster their culture by themselves. The bill would also strengthen the status of religion in the country by increasing the impact of Jewish jurisprudence and making it an inspiration to the legislator.
The purpose and significance of the law to reestablish the constitutional foundation of the State of Israel in a manner that elevates its Jewish character and compromises its democratic character threatens to destroy Israels democratic way of government, and to justify claims that Israel is a democracy for Jews only. This legislation clearly undercuts the Zionist ideal of the establishment of an exemplary, egalitarian and democratic society.
The presentation of the bill at this time, with tensions between Jews and Arabs running so high, is a political move lacking wisdom and sensitivity. It also raises the suspicion that its framers want to raise tensions further for political gain. The government, which is obligated to the Declaration of Independence and the protection of democracy in Israel, must reject this shameful bill outright.

(4,151 posts)Justice Minister Tzipi Livni decided to postpone the vote that was due to take place Sunday at the Ministerial Committee on Legislation on a Basic Law proposal that would solidify Israel as Jewish and democratic nation-state.
The bill, known in Israel as the Nationality Law, seeks to enshrine in law the nation-state of the Jewish people for the first time since Israel's foundation.
Livni decided to accept Minister Ya'akov Peri's request to postpone the vote, who dubbed the bill as "dangerous."
"The explosive situation that exists in the Arab sector at the moment has already led to violent clashes and casualties. A discussion on the 'Nationality Law' at this time is irresponsible," Peri said at the committee meeting.
Livni said there are similar bill proposals, and a joint committee will formulate understandings on the issue in the future.
Earlier, Prime Minister Benjamin Netanyahu said he was pushing forward MK Ze'ev Elkin's (Likud) proposal, noting changes will be made to the proposal before the bill is made into law.

The move is said to be in retribution for Justice Minister Tzipi Livni's decision to postpone the vote on a contentious 'Nationality Law'.
